Agder Kollektivtrafikk A/S (‘AKT’) hereby invites interested suppliers to submit an application to be pre-qualified for submitting tenders in a tender contest with negotiations for bus transport services in East 2022.
This Qualification documentation describes the qualification requirements and the requirements for the content of the request to participate in the tender contest. The qualification documentation is together with the remaining of the tender documentation published on Doffin, www.doffin.no and (Tenders Electronic Daily), ted.europa.eu.
The tender contest is conducted using an electronic competition implementation tool (Norwegian: "KGV"), EU-Supply.
Only tenderers complying with the qualification requirements will be invite to submit
tenders in the tender contest. Tenderers that
are not complying with the qualification requirements are rejected.

The contracting authority has an exclusive right to extend the contract for one or more periods,
to and including 30 June 2034 maximum.

Tax and VAT certificates
Tenderers must have their tax and VAT payments in order.
This must be documented by submitting a certificate of tax and VAT that is not
older than 6 months from the deadline for submitting a request for participation.
Foreign tenderers must submit an equivalent certificate in accordance with the legislation
in the country where the tenderer is established as a company. Foreign tenderers that are
liable to pay taxes and social contributions in Norway shall present a tax and VAT certificate, see above.
Company registration certificate
Tenderers shall be a legally established company, this shall be documented by
presenting a Company Registration Certificate or equivalent in accordance with the laws and regulations in the country
where the tenderer is registered as a company. The certificate must not be more than 1 month from
the deadline for requests for participation in the tender contest.
Certificate from the bankruptcy register.
The tenderer must submit a certificate issued by a competent body in the tenderer's
home country or the country where the tenderer is established. The certificate must verify that
rejection reasons regarding bankruptcy and insolvency etc. in accordance with the Utilities Sector's Regulations
§ 20-2 third paragraph, letter b.
Joint venture
If a request is submitted by several legal subjects in a Joint Venture or similar,
a copy of the agreement that regulates the joint venture must be attached.
The parties are required to have joint and several liability.
Minste nivå(er) av standarder:
The tenderer must present the revised and approved accounts for the last 3 years (2019, 2020 og 2021). The tenderer must also complete and submit the form in Appendix
4 in the Qualification documentation.
If the Contracting Authority deems it necessary, the Contracting Authority will obtain a credit appraisal of the tenderer.
- Experience from equivalent assignments.
- Stand-by system
- The tenderer must have sufficient experience from equivalent assignments. This must be
documented by presenting information on the most relevant assignments
(minimum one) that the tenderer has provided during the last 3 years. Assignments that are
initiated but not completed can also be considered relevant.
The tenderer shall use the form in Annex 6 in the Qualification documentation for this, where you will also find what detailed documentation requirements apply.
- The Applicant must have a satisfactory stand-by system. The Applicant must enclose
a description of its stand-by system and particularly provide an account of:
how stoppages, disruptions in production/breakdowns and delays are managed,
the tenderer's routines for accidents, fire, robbery etc.

Tenderers who would like to petition for an interim court order against the contracting authority's decision to
reject the tenderer's request for participation in the contest, must submit the petition to a competent
court within 15 days, calculated from the day after the contracting authority sends notification of
the rejection in accordance with the utilities regulations, Section 20-10 third paragraph.
