Legal services for the South Eastern Norway Regional Health Authority with subsidiary health trusts

The South Eastern Norway Regional Health Authority and the subordinated health trusts have continuous requirements for legal consultancy services in connection with the organisations' activities. Even though the requirement for legal services is basically covered by the internal resources at the contracting authority, there is a requirement for external counsel in connection with e.g. a lack of available capacity or competence.
The Norwegian Hospital Procurement Trust, on behalf of the contracting authority, is therefore publishing an open tender contest for the procurement of legal services. The contracting authority would like to enter into a framework agreement with a full-range provider of legal services.
Consumption of services included in the procurement is estimated to be approx. NOK 25.2 million excluding VAT per annum. This volume is only a guideline and is in no way binding for the Contracting Authority or tenderer. In accordance with current case law, the estimated maximum value is also stated without obligations for the contracting authority or the tenderer. The estimated maximum value for the entire agreement period is NOK 121.1 million.

The contracting authority would like tenders for the following types of services:
-- Legal advice, both individual questions and major review work.
- Quality assurance
- Assistance with any appeals and/or dispute cases, including negotiations and procedures.
- Courses, conferences, seminars, etc.
Within the following legal jurisdictions:
1) Labour legislation and pension law (mandatory and rights)
2) Public procurements, state subsidies and competition law (the expected largest requirement is related to public procurements)
3) Contract law, with particular focus on complex ICT contracts
4) Technology and IT law, the Personal Data Act
5) Contract, judicial conditions in relation to real estate and the Planning and Building Act.
6) Company law (enterprise law), as well as tax laws. Both with focus on the health sector
7) The Public Administration Act, health legislation, pharmacies and medicines legislation
8) Immaterial law, legal status related to research (including questions about commercialisation, rights and research contracts).

Varighet: 24 måneder
Beskrivelse av fornyelser:
The framework agreement shall be valid for 2 years from the date the agreement is in force.
After that the contracting authority can extend the contract for up to one year at a time. The total maximum contract period is 4 years. The agreement will be automatically extended on the same terms unless the contracting authority, c/o the contract administrator, terminates the contract at the latest 2 months before the expiry date.
