Framework, Digital Safety Alarms

Tromsø kommune

Tromsø kommune (Tromsø Municipality) and the collaborating municipalities want to use this procurement to obtain a framework agreement for purchasing of digital safety alarms and associated sensors to use in the health and care service. The municipalities of Tromsø, Bergen and Harstad participate in this contest. Tjeldsund and Kvæfjord municipalities are included in Harstad Municipality's contract, while Kvam Municipality is part of Bergen Municipality's contract.

Justification for cancellation According to the Public Procurement Regulations § 25-4, first paragraph that a contracting authority can cancel a contest with immediate effect if there is a 'justifiable reason'. In order for there to be justifiable reason, there are two conditions that must be met. ‘The actual reason for the cancellation must be factual (the objective condition), and the contracting authority must not be able to be blamed for not having foreseen the relevant reason for the cancellation (the subjective condition)’, cf. The Simplification Committee point 26.2.1 based on case law and on Appeals Board practice. Tromsø Municipality has cancelled the contest in this instance, because errors and deficiencies have been discovered in the tender documentation. As has also been pointed out by the supplier, some questions have been received twice, and thereby some questions have been excluded from the tender.
