Framework agreement for the supply of electricity

TRV Gruppen AS

Konsernet TRV Gruppen AS and Tempevegen 25 AS would like to enter into a framework agreement with an energy provider for the delivery of electricity. The framework agreement will have a duration of four years. The contract will cover the Contracting Authority's total need for electricity, at spot price (Nord Pool spot), with a fixed mark-up per KWh through the contract's lifetime, for a total of 21 installations.

The group currently has 19 active installations/meter numbers, which are all read every hour. The estimated total consumption is 4 GWh a year. The maximum volume for the contract period is set to a total of 20 GWh.

Tempevegen 25 AS has 2 active installations, which are both read every hour. The estimated total consumption is 0.5 GWh a year. The maximum volume for the contract period is set to a total of 3 GWh.

A project will be started during the contract period for solar panels and self-supplied electricity at Trondheim Renholdsverk AS, but the size and scope of this has not yet been mapped. In addition, TRV Gruppen AS is looking at possibilities for further solar panel installations. This is only in the mapping phase and the scope is thus unknown. We would like the tenderer to procure excess electricity from future solar panel installations if this occurs.

Tenderers must be registered in a company register, professional register or a trade register in the country where the tenderer is established.

Documentation requirement:

- Norwegian companies: Company registration certificate

- Foreign companies: Documentation that the tendereris registered in a company register, professional register or a trade register in the state where the tenderer is established.

The certificate must not be older than 12 months from the tender deadline.

Økonomisk og finansiell stilling:

Tenderers must have the financial capacity to carry out the assignment/comply with the contractual obligations. Tenderers are required to be credit worthy and have satisfactory liquidity and solidity.

Documentation requirement:

 A credit rating based on the most recent accounting figures. The credit rating must not be older than 3 months. The rating must be carried out by a credit rating company with licence to carry out this service.

Qualification Requirement:

Tenderers must have experience from comparable assignments.

Documentation requirement:

A description of the three most relevant, equivalent assignments in the last three years.

The description must include a statement of the assignment´s value/scope, date and recipient (name, telephone number and e-mail address). The contracting authority must be given the authority to contact the person in question. The references will only be contacted if required.

Tenderers must have a quality assurance system.

• Documentation of the quality assurance system. An account of the tenderer´s existing routines and documentation that the requirement for a quality assurance system/management system applicable for the assignment is covered. If this is described in the tenderer´s quality assurance system, in accordance with ISO 9001 or equivalent, documentation of this can be enclosed.

Tenderers must have an environmental management system.

• Documentation of an environmental management system. Copies of any certificates, such as ISO 14001, EMAS, Miljøfyrtårn or equivalent, are to be enclosed. If a tenderer does not have an environment management system, the tenderer must be willing to implement one within 6 months of the contract being signed. This must be documented in writing.

Tenderers must have a concession for energy turnover.

Checked in NVE's register of concessions.

Tenderers must have a binding cooperation relationship with any sub-contractors.

• Signed commitment statement (Annex 8).

If a tenderer must rely on another company´s competence or capacity to fulfil a qualification requirement, a separate ESPD form must be enclosed for this sub-supplier. A signed statement of commitment from the relevant subcontractor must be submitted.

• Completed ESPD - section II D.

The public procurement regulations state that if a tenderer uses the capacity of other companies, he must document that he can use the necessary resources, for example, by attaching a commitment statement (annex 8), cf. the PPR section 16-10 (2). This provision applies in addition to the provision on the ESPD.

Section 25-2. Waiting period before the contract is signed.

(1) The contracting authority can enter into a contract after the waiting period has expired at the earliest, this period is determined by the contracting authority. The waiting period shall be at least 10 days calculated from the day after the notification on the chosen tenderer has been sent. If the contracting authority has made an exception from the requirement for using electronic communication, the waiting period shall be a minimum of 15 days.

(2) The waiting period requirement does not apply

a) when the contracting authority has no obligation to announce the contest, section 13-3 and section 13-4

b) when the chosen tenderer is the only affected tenderer

c) when the contracting authority awards contracts under a framework agreement

d) when the contracting authority awards contracts under a dynamic purchase system.
