Justification for cancellation The legal basis for the cancellation is PPR § 25-4 (1), stating that the contracting authority can cancel the contest with immediate effect if there is justifiable reason. The justifiable basis for cancellation is that the contracting authority, by implementing the contest, risks ending up in a situation where the same sub-contractor has two or more of the contracts for lot 1. This situation can result in call-offs, in the event of a mini-competition, not working as intended, and the contract will thus not work as planned. For the same reason, there may occur capacity problems at the subcontractor. Lillestrøm municipality finds that at present it is impossible to make regulations of the mentioned situation within the framework of legal changes, cf. the Public Procurement Regulations § 14-2 (1).The tender contest is therefore cancelled, cf. the Public Procurement Regulations, § 25-4 (1). Lillestrøm municipality apologises for the inconvenience the cancellation entails for the tenderers. A new tender contest for this contract will be published shortly.
