The intention is to procure consultancy and engineering design services that will cover BYM and VAV's needs in accordance with the execution responsibility in the town development areas. The services will vary in size and scope from year to year and will consist of, amongst other things, the preparation of draft projects, preliminary projects, construction schedules, tender documentation for both turnkey contracts and execution contracts, development plans/building applications, as well as professional advice and coordination of private and public plans at all levels within the town development areas. In addition, the procurement includes the preparation of VPKL for PBE's area plan work. See Annex 2, Requirements Specification.

BYM has taken on the execution responsibility for the municipal engineering infrastructure in a number of geographically limited town development areas in Oslo. Per 1 January 2021 BYM has the execution responsibility for the following town development areas:

• Ensjø,

• Løren/Økern,

• Vollebekk,

• Bryn,

• Breivoll,

• Haraldrud,

• Hasle,

• Skøyen,

• Storo/Lillo,

• Frysja,

• Skullerud,

• Mortensrud (limited).

BYM can take on execution responsibility for even more town development areas in the contract period. These can then be added during the contract period.

BYM has been asked to take on execution responsibility for Bjerke, Oslo S, Furuset, and Helsfyr. This has not yet been clarified with the Town Council Department for Environment and Transport (MOS).

The execution responsibility involves responsibility for projects that, after signed development contracts, will be implemented under the aegis of the municipality (cash contributor) or that the developers themselves will implement (real contributor). BYM's responsibility for real contributors is to approve the landscape plan and construction schedule, and follow-up that the measure is carried out in accordance with the approved landscape plan and construction schedule.

The execution responsibility covers measures that are regulated as public measures such as roads, streets, squares, cycle paths, parks, green structure, footpaths, and accompanying technical installations such as electricity, tele, which are affected indirectly or directly by the public measure.

The Agency for Water and Sewage (VAV) is responsible for the water and sewage network (the WS network) that is affected indirectly or directly by public measures. VAV therefore cooperates closely with BYM in the town development areas where BYM has execution responsibility. In addition BYM has, together with VAV, responsibility for the preparation of the Guiding Plan for Cables and Pipelines (VPKL) for PBE's area plan work (area development in accordance with the Planning and Building Act, guiding plan for public spaces, or the measure list for public spaces).

The procurement is also being made on behalf of VAV that can, if required, make separate call-offs under the framework agreement in consultation with BYM. VAV reserves the right to make separate procurements for the same type of services when VAV deems it appropriate, possibly using separate framework agreements.

The contracting authority intends to enter into a framework agreement with 2-4 tenderers, provided that sufficient suitable tenders are received.

The framework agreement will be valid for 4 years from when it is signed. The contracting authority has an option to extend the contract for a further 1 + 1 + 1 year. The maximum contract period is up to 7 years.

An assessment of whether to take up the options will start in good time before the contract expires. The use of the option will be clarified with the tenderers at the latest 3 months before the contract expires.

The estimated annual value is approx. NOK 50 000 000 excluding VAT and price regulations. The total estimated contract value for the framework agreement (4 + 1 + 1 + 1 years) is approx. NOK 350 000 000 (excluding VAT), including the estimated costs for VAV.

The sum is only an estimate and is not binding for the contracting authority as it depends on the annual grants from the town council. There is, thus, great uncertainty connected to the estimate.

The framework agreement will be a non-exclusive contract and the contracting authority reserves the right to hold separate contests within the contract's stated services and enter into contracts outside the framework agreement when BYM deems it appropriate.

• Tenderers must have the economic capacity to carry out the assignment/contract.

Documentation requirement:

• credit evaluation/rating, not older than 6 months, based on the last known accounting figures;

• the contracting authority retains the right to obtain a credit rating of the tenderer, which will be used as a basis in the evaluation.

Teknisk og faglig kapasitet:

Requirement:

• tenderers must have the required competence and experience within consultancy and engineering design services of technical infrastructure such as roads/streets, urban spaces, parks, and bridges.

In addition, tenderers must have the required competence and experience within consultancy and engineering design services for accompanying technical installations such as water and sewage installations (main pipelines), surface water, electrical installations (high and low voltage), tele, ICT.

The competence must include the draft/preliminary project, development plan, and construction schedule phases.

The competence must be from projects in urban areas with many user groups/types of road users, heavy traffic, and complicated technical infrastructure.

Documentation requirement:

An overview of relevant reference projects carried out in the last 5 years, including their value, date, and the contracting authority with a contact person.

This must state which disciplines and phase the tenderer contributed to the project.

• tenderers must have a sufficient number of resources with the required professional competence for the assignment.

• An account of the tenderer's available staff capacity within the disciplines defined for the assignment in the contract period.

• tenderers must have a quality assurance system in order to fulfil the obligations of the contract.

• an account of the quality assurance system.

If a tenderer is certified, it is sufficient to attach a copy of certificates issued by independent bodies confirming that the tenderer fulfils specific quality assurance standards, for example ISO 9001:2008 or equivalent.

• an environmental management system is required in order to fulfil the obligations of the contract.

• an account of the environmental management system and a description of how environment work is carried out.

If a tenderer is certified, it is sufficient to attach copies of certificates issued by the independent body. Reference is made in this regard to EMAS (the community scheme for environmental management and environmental audits) or to environmental management standards based on relevant European or international standards.
