The Norwegian Institute of Public Health already has the existing contracts for four valent seasonal influenza vaccine for the season 2022/2023 with respectively Sanofi Aventis (Vaxigriptetra) and Mylan Healthcare (Influvac Tetra), with a combined volume of 900,000 doses. Increased national request for seasonal influenza vaccine in recent years makes it necessary to carry out supplementary procurement for the season 2022/2023, in order to cover the need beyond the volume in the existing contracts.

The only award criteria in the competition is lowest price. The tender documentation has several minimum requirements for the vaccine. All the minimum requirements must be fulfilled.
The procurement will be carried out in accordance with the Public Procurement Act of 17 June 2016 (PPA) and the Public Procurement Regulations (PPR) part I and part III. A contract will be awarded in accordance with the open tender contest procedure, cf. the Public Procurement Regulations § 13-1 (1).

FHI has received signal that there will be significant risk that doses cannot be allocated to Norway if the procurement process is not carried out before the middle of December. As FHI cannot risk Norway being left without doses, it has been decided to hold a contest with a 15 day tender deadline. Incidentally, the procurement will be carried out in-line with the procurement regulations.

The total contract volume is 700,000 - 900,000 doses
In this contest, the Norwegian Institute of Public Health in consideration of preparedness, will primarily aims to award two sub-contracts where the total volume is distributed as follows:
60% of total volume, 420,000 - 540,000 doses
40% of total volume, 280,000 - 360,000 doses
The actual number of doses will be clear upon award.

Teknisk og faglig kapasitet:
The tenderer must have the requisite permissions to be able to fulfil the contract.
Documentation requirement:
If the tenderer is the manufacturer of the vaccine, permission must be presented from relevant EU/EEA authorities to manufacture pharmaceuticals.
If the tenderer is not the manufacturer of the vaccine, the requisite permissions from relevant EU/EEA authorities to trade in pharmaceuticals must be presented.
If the tenderer imports the vaccine, the import license that includes the offered vaccine must be presented.
NB: for instances where tenderers are a Norwegian company it is sufficient to present a Norwegian manufacturer’s or wholesaler’s license that applies to the Norwegian company.
Kontraktutførelse
Vilkår for kontraktoppfyllelse:
• Supplier no. 1 is obligated for the 2022/2023 season to be able to deliver at a minimum the awarded number of doses in accordance with the agreed delivery plan (Supply Agreement point 3.2, bullet point 1)
• Supplier no. 2 is obligated for the 2022/2023 season to be able to deliver at a minimum the awarded number of doses in accordance with the agreed delivery plan (Supply Agreement point 3.2, bullet point 2)
• Supply Agreement point 4.2 states requirements for delivery volume within given deadlines.
If the received tenders indicate a different distribution (than 60-40%), refer to the tender documentation point 6.1, the indication of supplier and volume in the Supply Agreement point 1.3, 3.2, 3.3, 4.2 and 6.2, can be changed to suit the given situation.

The procurement was carried out in accordance with the Public Procurement Act (PPA) of 17 June 2016 and the Public Procurement Regulations (PPR) part I and part III of 12 August 2016. Contract award was done in accordance with the open tender contest procedure, cf. the Public Procurement Regulations § 13-1 (1).

On the following basis, the real contract value for each sub-contract is not given in the notice:
Price per dose is the only price element in the contest. The Norwegian Institute of Public Health has determined that pursuant to the Freedom of Information Act §13 and the Public Administration Act §13 first paragraph point 2), unit prices (price per dose) is information of competitive importance to keep confidential from the tenderers who could be awarded sub-contracts, and that the information is thereby subject to confidentiality. If the real value of the sub-contracts was stated, it would be possible to derive unit prices using information on the number of doses.

The Norwegian Institute of Public Health states that the combined value of both sub-contracts is significantly lower than the previously estimated procurement total value (point II.1.7 the Procurement’s total value). The value of each sub-contract is over the EEA threshold.
