This contract work consists of engineering design services for and the construction of a new E39 between Betna and Hestnes.
(The distance from Betna to Hestnes is approx. 17.5 km measured along the existing E39.)
The construction of a new E39 between Betna and Hestnes has a total length of 12.8 km and includes 3 development plans:
• Betna – Klettelva,
• Klettelva – Otneselva,
• Otneselva – Hestnes.
5 bridges, 3 overpasses and 3 culverts must also be constructed on the road stretch.
The construction work also includes drainage for the road and side areas, levelling, including the re-establishment of cultivated land and preparations for a new shooting range at Klettelva. In addition there will be electrical work, and temporary solutions for traffic management.
The tenderer will engineer and execute all the construction work.

* As agreed between the Norwegian Public Roads Administration and Heim Municipality in 2020, the LL area that is not dotted between the shooting range and the new E39 can be used as a temporary barracks area.
** There is a break in the chain between the development plans Betna – Klettelva and Klettelva — Otneslva.
The concurrence in the profile number between the mentioned development plans is profile 5610 and profile 2610 respectively.
*** The project otherwise uses all accesses in accordance with the development plan Klettelva — Otneselva between profile 0-2610.

Qualification requirement:
Tenderers must be a legally established company or consist of a group of suppliers who are legally established companies.
The requirement also applies to any subcontractors. C.f. point 4.
Documentation requirement:
1) Certificate from the register of business enterprises, or equivalent certificate of legal registration in the country where the tenderer, or the companies that together make up the tenderer, cf. point 4.2, is/are established, as well as for all supporting companies, cf. point 4.1.

Tenderers must be certified or is in the process of certification in accordance with ISO 9001 (2015), with relevance to comparable transport projects.
1) Certificate issued by independent bodies, documenting that the tenderer is certified in accordance with ISO 9001 (2015). The independent body must be accredited by Norwegian Accreditation or an equivalent body in another EEA state;
2) If the tenderer is not certified, documentation must be provided by an independent body substantiating that the tenderer is in a certification process. The documentation must show that the process will be initiated minimum 3 months prior to the tender deadline;

3) If a tenderer uses other companies to fulfil the requirement, the tenderer must also account for how the environmental management system of the supporting entity will specifically be incorporated in the relevant contract.
Tax and VAT certificate issued by a competent body in the tenderer's home country, or the country where the tenderer is established, which substantiates that the tenderer has fulfilled his tax and duty obligations, c.f. the public procurement regulations Section 24-7, first paragraph, letter b), c.f. Section 24-2 (1), letter b) and (3), letter a). The certificate must not older than 6 months, calculated from the deadline for requesting participation.

The contracting authority requests that all tenderers note that if they are awarded a contract, the contracting authority will ask for tax and value added tax certificates equivalent to those submitted by the tenderer, be submitted for each sub-contractor who will carry out work under the contract for more than NOK 500 000, cf. the public procurement regulations section 7-2 third paragraph. Økonomisk og finansiell stilling:
Tenderers must have adequate economic and financial capacity to comply with the contractual obligations and fulfil the following requirements:
1) Tenderers must have equity of minimum NOK 90 million;
2) Tenderers must have an equity ratio of at least 10 %;
3) The average annual turnover for the last 3 fiscal years must be minimum NOK 300 million.
Minste nivå(er) av standarder:
1) The tenderer's annual financial statements annual report and audit report for the last 3 years and any newer information (quarterly accounts) that are of significance to the tenderer's accounting figures;
2) A brief statement regarding information on the economic conditions or losses that are not documented other places, and that are required to be documented in accordance with Norwegian and/or international accounting standards;
3) An overview of any newly implemented, ongoing or impending tax or public reviews of the tenderer’s business;
4) An overview of any significant incidents that have occurred after the most recently audited financial statements were issued;
5) Completed form E1 point 3.
If the tenderer has valid reasons for not being able to provide the documentation requested by the contracting authority, the tenderer can document his economic and financial capacity by presenting any other document that is relevant to the fiscal figures/economy and that the contracting authority deems suitable. Tenderers must substantiate why they can’t present the documentation required by the contracting authority.

Teknisk og faglig kapasitet:
Tenderers must have sufficient experience of a relevant nature and degree of difficulty from the following works:
• road construction;
• bridges and constructions;
• engineering design services, including model based engineering design services for multi-disciplinary installations that include bridge constructions and road installations, with at least one contract that involved engineering design services, having a contract value of minimum NOK 200 million.

Tenderers must have experience from the execution of this work. It is not sufficient if a tenderer only has experience from managing subcontractors' execution. If the tenderer only has experience from managing subcontractors, the tenderer must rely on other companies that have the necessary experience from the execution of the relevant work, see more detailed information in B2 point 4.1.

NPRA and other builders' experiences with the tenderer will be appraised.
Tenderers are required to show references to relevant contracts that they themselves have carried out in a satisfactory manner.
Conditions that will be evaluated are connected to i.a.:
• documentation of completed quality;
• fulfilment of contracts;
• compliance with provisions and procedures for HSE;
• compliance with provisions for wages and working conditions;
• observance of deadlines;
• follow up during the warranty/claims period;
• use of apprentices.
Tenderers must have a system that shows that they work proactively to ensure safety, health and working environment (HSE), with relevance for equivalent work as that covered by this contest. The system will be subject to periodic review.
Tenderers and their central contract facilitators ought to have an average H2 value lower than 15 for the last 3 years.
If the H2 value is higher than 15, an account must be given of the development tendency of the H2 value.
If a tenderer is a working partnership (supplier consortium), the requirements apply for each of the participants.
The H2 value is defined as the number of work accidents with and without absence, divided by the hours worked multiplied by 10 to the power of 6.

A list of up to eight but no less than three contracts that the tenderer (or companies that the tenderer will rely on) has implemented or is implementing in the last 5 years, calculated from the submission deadline for participation in the competition.

The list must contain the following for each of the contracts, which are entered in tables in chapter E1 point 4.1:
(a) tenderer's name;
(b) name of the recipient (contracting authority);
(c) title of the contract;
(d) description of the nature of the contract work, including the relevance as regards the qualification requirement;
(e) which work was carried out by the tenderer, and what work was;
(f) dates of delivery;
(g) contract value excluding VAT;
(h) the place where the project was carried out;
(i) reference person/contact person at the contracting authority with contact data (telephone number and email address), and a statement of the person in question's role during the contract. Tenderers are responsible for ensuring that reference persons are available and will provide a reference.

The contracting authority has the right to give weight to any of their own or other contracting authorities' experiences beyond the given references, positive and negative, with the tenderer and any cooperating companies, c.f. point 4, that are of relevance for assessing how the tenderer can be qualify.
