The contracting authority intends to enter into a framework agreement with a strategic collaboration partner with responsibility for maintenance of and upgrades to the Nansen class in its lifetime at the tenderer's own location. The aim of the framework agreement is to ensure technically available frigates for the Navy. The strategic collaboration partner will be responsible for the planning, coordination, and execution of activities connected to main overhauling of the frigates, including both the Norwegian Defence's own deliveries and deliveries from existing and future suppliers for the Norwegian Defence.
Main overhauling means activities connected to the classification (main maintenance) of the vessels, as well as other planned maintenance and upgrading activities that are carried out in parallel.

Beskrivelse av opsjoner:
The framework agreement will be valid for 4 years with an option for an extension one or more times depending on the lifetime of the Nansen class and the need for maintenance and upgrade of them. The framework agreement can be extended up until the last vessel in the Nansen class has been phased out.

Foreign tenderers: Verification that the tenderer is registered in a company register, professional register or a trade register in the state where the tenderer is established.

Økonomisk og finansiell stilling:
REQUIREMENT: Tenderers must have their tax and VAT payments in order. DOCUMENTATION REQUIREMENT: Tax certificate not older than 6 months from the application deadline. Tax certificate means: Certificate issued by the tax collector or the Norwegian Tax Authority for: VAT. tax, payroll tax.

REQUIREMENT: Tenderers must have sufficient economic and financial capacity to fulfil the contract, including satisfactory operating profit margin, degree of liquidity and equity. DOCUMENTATION REQUIREMENT: The tenderer must submit the following documents: 1: The tenderer’ Annual Financial Statement (including notes with the Board and auditor’ report) from the last three years (2017-2020) for the tenderer and any parent company. If the annual accounts for 2020 have not been completed by the deadline to submit requests for this contest, the Annual Financial Statements for the previous year must be included. 2: Tenderers must also confirm that they are willing to present any additional information upon request. 3: Tenderers must confirm that they are open to necessary access to information and permit the contracting authority to undertake necessary reviews/analysis of the tenderer's financial ability to fulfil the framework agreement. 4: Tenderers must accept a cost audit and give the contracting authority's control body insight in any changes during the framework agreement and any future contracts that will be awarded to the tenderer without a contest. Tenderers must attach a written declaration on consent to such insight. If a tenderer will rely on the capacity of other companies to fulfil this requirement, the contracting authority will require that they are joint and severally liable for the implementation of the framework agreement. If a tenderer has valid reasons for not being able to provide the documentation requested by the contracting authority, the tenderer can prove his economic and financial position with any other document that the contracting authority deems suitable.

Teknisk og faglig kapasitet:
REQUIREMENT: The tenderer's shipyard, infrastructure, and competence connected to the deliveries must be in Norway for the duration of the framework agreement. DOCUMENTATION REQUIREMENT: The tenderer must submit a binding declaration verifying that the shipyard/infrastructure will be in Norway for the duration of the framework agreement.

REQUIREMENT: The tenderer must have sufficient capacity to fulfil the delivery in the framework agreement. Assessment of the tenderer’ capacity is made against the scope described in the qualification documentation. DOCUMENTATION REQUIREMENT: The tenderer must submit the following documentation: 1: A description of technical personnel and technical units at the tenderer's disposal for implementation of deliveries on the framework agreement. 2: Tenderers must describe their capacity to handle swings in scope, particularly as regards MLU, including how many persons within the different professions the tenderer has for assignments for the contracting authority, as well as what notification periods will possibly apply.

REQUIREMENT: The tenderer must have competence that corresponds to the requirements in the Qualification Documentation, Annex 6. DOCUMENTATION REQUIREMENT: Tenderers must submit the following documentation: 1: A description of how the requirements in annex 6 will be met. 2: Tenderers must attach a list of personnel who have relevant certification and approval in accordance with annex 6 Competence Requirements. Requirement: Tenderers must have good experience from similar deliveries. Good experience means that the tenderer has completed several similar assignments with good customer satisfaction. Similar assignments means that the experience must be from equivalent types of assignment, scope, and complexity as that covered by this framework agreement. For MLU, tenderers must handle a scope that is equivalent to approx. 300-400 days work in one or more shifts. Tenderers must refer to experience from deliveries of this size. DOCUMENTATION REQUIREMENT: The tenderer must attach an overview of the tenderer's three to five most relevant assignments in the last five to ten years. The overview must include a statement of: The assignment's value. Date. The contracting authority´s name. Contact person at the contracting authority (name, telephone number and email address). A brief description of the assignment. Relevant for this framework agreement. It is the tenderer's responsibility to document relevance and complexity through the description. The contracting authority will contact the given reference person when selecting the qualified tenderers, cf. the qualification documentation, point 5.4. If the services were for public contracting authorities, this must be documented by certificates issued or confirmed by the authority concerned. If the services were for private contracting authorities, certificates should be issued or confirmed by these.

REQUIREMENT: Tenderers must have established, implemented, and maintained a system for quality control at a level with the last revision of the ISO 9001 series. DOCUMENTATION REQUIREMENT: Tenderers must submit the following documentation: 1: Documentation that that they have a system in use for quality management, on a level with the ISO 9001 series, the AQAP series, or equivalent standards. If a tenderer is certified in accordance with ISO 9001 or equivalent standard, it is sufficient to submit a copy of the valid certificate.2: Tenderers must confirm that they give the contracting authority's quality assurance authority access to facilities and systems through the pre qualification, tender, and production phases in order to carry out verification activities. Tenderers must also confirm that this also applies for sub-suppliers they will rely on to qualify for the contest.

REQUIREMENT: Tenderers must have a system for systematic environmental management on a level with the latest version of the ISO 14001 series. Tenderers must have a system for environmentally friendly waste management. DOCUMENTATION REQUIREMENT: Tenderers must submit a description of environmental management measures and policy that has been implemented in the company. If a tenderer is certificate in accordance with ISO 14001 or equivalent standard, it is sufficient to present a copy of a valid certificate.

REQUIREMENT: Tenderers must have available sites and facilities in Norway that fulfil the contracting authority's requirements, see annex 5 of the qualification documentation. The contracting authority and sub-suppliers will need facilities for the execution of work. An estimated 50-120 persons from the contracting authority will, in periods, carry out work at the tenderer's location. DOCUMENTATION REQUIREMENT: Tenderers must prepare a document that answers the requirements in Annex 5 and that includes the requested information. If a tenderer does not have a dock and shipyard facilities, or other infrastructure that fulfils the requirements in Annex 5 at the time of the qualification application, the tenderer can submit a realistic and verifiable plan for the execution of the upgrades/modifications in question. The contracting authority will carry out a site inspection of the dock and shipyard facilities or other infrastructure, see point 5.2 in the Qualification Documentation.

REQUIREMENT: Tenderers must be qualified for, and willing to enter into a security contract with the contracting authority for the framework agreement at the stated classification level. Furthermore, tenderers must achieve a supplier clearance from the Norwegian National Security Authority (NSM) for the framework agreement. DOCUMENTATION REQUIREMENT: Tenderers must state whether they have a security contract and any supplier clearance. Documentation must be provided of any such clearance. If a tenderer does not have such clearance, the tenderer must confirm that he: a) does not have any reason to believe that such clearance will not be given by the Norwegian National Security Authority (NSM), b) is willing to give NSM all the necessary information that is required to achieve supplier clearance, c) will ensure that his personnel have security clearance at the required level, d) will ensure that any sub-suppliers have a security contract or supplier clearance at the required level.

REQUIREMENT: Tenderers must subjugate to ownership control in accordance with the Security Act, section 10-1. DOCUMENTATION REQUIREMENT: Tenderers must confirm with a self-declaration that the company will subjugate ownership control.
REQUIREMENT: Tenderers must only use sub-suppliers that are registered in countries that Norway has a security cooperation with. Deviations from this must be approved by the contracting authority. DOCUMENTATION REQUIREMENT: Tenderers must confirm that they will use international sub-deliveries from countries that Norway has a security cooperation with. In dispute cases, the tenderer must ask the contracting authority whether Norway has a security cooperation with the country in question.

REQUIREMENT: All personnel who shall carry out work on-board must be able to achieve security clearance at CONFIDENTIAL level. Some must also achieve security clearance at SECRET level. DOCUMENTATION REQUIREMENT: Tenderers must submit a self-declaration stating that all personnel (both the tenderer’s and sub-supplier’s) that will carry out work on board will have the necessary security clearance.

REQUIREMENT: Tenderers must be able to use a sufficient number of personnel who can be mobilised. Only personnel with Norwegian citizenship can be mobilised. Tenderers must be able to deliver goods and services as specified in the framework agreement in times of peace, crisis, conflict, and war. DOCUMENTATION REQUIREMENT: Tenderers must submit a self-declaration confirming that the tenderer has a sufficient number of personnel who can be mobilised. In order for tenderers to be deemed to have sufficient capacity, tenderers must as a minimum have: 30 skilled electricians, 20 skilled mechanics, 5 skilled hull workers, 5 skilled ISO workers, and 1 project manager.

The tenderer must have a shipyard located in Norway for deliveries during the framework agreement. Furthermore, a security contract and supplier declaration will be entered into with the selected tenderer on a CONFIDENTIAL level.
