Lillestrøm Kommune

The competition concerns a development project for 2 new nurseries for Lillestrøm municipality.
The project must be executed with one contract partner who executes both nurseries as one turnkey contract.
The contract includes the construction of 2 approximately identical nurseries with a total of 24 identical departments for children.
The gross area of each nursery is approx. 3 900 m, comprising 12 departments with a total capacity for 183 children and approx. 50 employees. The outdoor area of the nursery is approx. 7 decares.
The contracting procedure is executed in accordance with NS 8407 with adjustments given in the tender documentation.
The project encourages use of prefabricated systems for the nurseries, which also can be used for future nurseries’ projects in the municipality.
Fixtures and fittings are not included in the contract.
The total contract value is estimated to 150 000 000 NOK excluding VAT. The value is an estimate and is non-binding. The contract is subject to budgetary funding.

A draft of the tender documentation is attached to this qualification documentation. The contracting authority reserves the right to make smaller, unsubstantial alterations of the documentation prior to inviting the tenderers to submit tenders.
Contract NS8407
The contracting authority shall use NS8407 for this contract, with particular contract terms and terms related to seriousness.
Contract period: a contract is expected to be signed 30.6.2020.
Start of works: immediately after the contract is signed.
Completion/takeover, construction works: Approx. 12-15 months after the initiation date.
The contract sum is not subject to regulation.
Contract terms
The contractual relationship will be regulated by NS 8407:2011, with the accompanying standard contract terms. The tender documentation annex is a part of the contract documentation. Tenderers must study all contract terms.
The contract must be used with the following exceptions and adjustments:
Construction form 8407A must be used:
— Point 4:
1) Refer to part II, tender documentation B contract terms;
2) Refer to point 5 seriousness terms.
— Point 6:
Alternative 1: the contract sum is subject to index adjustments;
Alternative 2: See annex part II the tender documentation B contract terms, point B.2.17.
— Point 7: see the tender form.
— Point 8:
Alternative 1: the turnkey contractor must present required guarantees.
— Point 9:
Alternative 2: the contracting authority will not provide any guarantees.
— Point 10:
Alternative 1: the turnkey contractor is responsible for required insurances.

Vilkår for deltakelse
Økonomisk og finansiell stilling:
Tax and VAT certificates
Tenderers must have their tax and VAT payments in order (ESPD: Part II A.e).
Documentation requirement: requirement for certificate of paid VAT, tax and social security contribution. A certificate issued by the competent authority in the tenderer's country, confirming that the tenderer has met their obligations in regard to payment of VAT, tax and social security contributions in the country where the tenderer/contractor has their headquarters the (Norwegian certificate for Tax and VAT is combined and ordered from altinn.no, previously RF-1244) in accordance with the legislation in the country. The certificate must not be more than six months old.

This also applies to any sub-suppliers that are needed to fulfil the contract.
The contracting authority is not allowed to request the certificate if he has already received it, in accordance with the regulations § 17-1(4). If you have submitted a tax certificate to the contracting authority and it is still valid at the time of the tender submission for this contract the tender submission deadline, for this contest, you are not obliged to submit a certificate now. If this is the case, state when and to whom the certificate was previously submitted. You can, however, enclose the certificate voluntarily if you want.

The contracting authority also demands access to an extended tax certificate and we therefore ask that the attached authorisation is signed and submitted.
Other economic and financial requirements: economic and financial standing
Requirements regarding the tenderer's economic and financial standing: The financial capacity to fulfil the contract is required (ESPD: Part IV B.58-3).
Documentation: The contracting authority will assess finances through the company and accounting information system Proff Forvalt (www.forvalt.no). Tenderers are asked to submit other information they believe is relevant. The contracting authority reserves the right to obtain supplementary information about the tenderer's finances.

Teknisk og faglig kapasitet:
There are requirements regarding the tenderer's technical and professional qualifications.
The tenderer must have a satisfactory quality assurance system (ESPD: Part IV B58-4).
Documentation requirement: certificate of the company's quality system/management system issued by independent bodies that confirms that the tenderer comply with certain quality assurance standards, for example ISO certification. The contracting authority will also accept other documentation which shows that the tenderer has equivalent quality assurance measures.
