The road will be developed in the open air and is planned as a 2/3 lane road with a central reservation. Most of the route is in virgin terrain. The contract includes some constructions, including eight subways/culverts dimensioned for agricultural machines, eight bridges between 15 and 90 metres, and a 100 m long 4-land environment tunnel.

Qualification requirement:

The tenderer must be a legally established company or consist of a group of suppliers who are legally established companies.

The requirement also applies to any subcontractors. C.f. point 4.

Documentation requirement

• Company Registration Certificate from the Brønnøysund Register Centre. Foreign tenderers can submit an equivalent certificate in accordance with the legislation in the tenderer's country of establishment.

• Completed table in chapter E1 point 2.1 and possibly point 2.3.

Tax and VAT certificate issued by a competent body in the tenderer's home country, or the country where the tenderer is established, which substantiates that the tenderer has fulfilled his tax and duty obligations, c.f. the public procurement regulations Section 24-7, first paragraph, letter b), c.f. Section 24-2 (1), letter (b) and (3), letter (a). The certificate must not older than 6 months, calculated from the deadline for requesting participation.

In cases where the above-mentioned certificate is not issued in a tenderer's home country, or the country where the tenderer is established, or if they do not cover all the rejection grounds mentioned in the public procurement regulations Section 24-2 (1) letter (b) and (3) letter (a), tenderers must present a declaration given under oath or insurance that a competent organ in the tenderer's home country or the country where the tenderer is established, which confirms that such conditions do not exist, c.f., the public procurement regulations Section 24-7 (2).

Tenderers must be certified or is in the process of certification in accordance with ISO 9001 (2015), with relevance to comparable transport projects.

Documentation requirement:

1) Certificate issued by independent bodies, documenting that the tenderer is certified in accordance with ISO 9001 (2015). The independent body must be accredited by Norwegian Accreditation or an equivalent body in another EEA state.

2) If the tenderer is not certified, documentation must be provided by an independent body substantiating that the tenderer is in a certification process. The independent body must be accredited by Norwegian Accreditation or an equivalent body in another EEA state. The documentation must show that the process will be initiated minimum 3 months prior to the tender deadline.

3) If a tenderer uses other companies to fulfil the requirement, the tenderer must also account for how the environmental management system of the supporting entity will specifically be incorporated in the relevant contract.

Økonomisk og finansiell stilling:

Tenderers must have adequate economic and financial capacity to comply with the contractual obligations and fulfil the following requirements:

1) equity minimum NOK 100 million;

2) an average annual turnover of minimum NOK 250 million for the last 3 financial years;

3) tenderers must have an equity ratio of at least 10.

Minste nivå(er) av standarder:

1) The tenderer's annual financial statements, annual report and audit report for the last 3 years and recent information (quarterly accounts) which is of importance to the tenderer's fiscal figures.

2) A brief statement regarding information on the economic conditions or losses that are not documented other places, and that are required to be documented in accordance with Norwegian and/or international accounting standards.

3) An overview of any newly performed, ongoing or impending tax or public reviews of the tenderer’s business.

4) An overview of any significant incidents that have occurred after the most recently audited financial statements are issued.

If the tenderer has valid reasons for not being able to provide the documentation requested by the contracting authority, the tenderer can document his economic and financial capacity by presenting any other document that is relevant to the fiscal figures/economy and that the contracting authority deems suitable. Tenderers must substantiate why they can’t present the documentation required by the contracting authority.

Teknisk og faglig kapasitet:

Tenderers must have sufficient experience of a relevant nature and degree of difficulty from the following works:

— road construction;

— bridges and constructions;

— engineering design, including model based engineering design.

The tenderer must have experience from the execution of the works, it is not sufficient that the tenderer only has experience from managing the subcontractors’ execution. If the tenderer only has experience from managing sub-contractors, the tenderer must rely on other companies that have the necessary experience from execution of the relevant works, see more detailed information in B2 point 4.1.

NPRA and other builders' experiences with the tenderer will be appraised.

Tenderers are required to show references to relevant contracts that they themselves have carried out in a satisfactory manner.

Conditions that will be evaluated are connected to i.a.:

• documentation of completed quality;

• fulfilment of contracts;

• compliance with provisions and procedures for HSE;

• compliance with provisions for wages and working conditions;

• observance of deadlines;

• follow up during the warranty/claims period;

• use of apprentices.

Tenderers must have a system that shows that they work pro-actively to ensure safety, health and working environment (HMS), with relevance for equivalent work to that included in this competition. The system will be subject to periodic review.

Tenderers and their central contract facilitators ought to have an average H2 value lower than 12 for the last 3 years.

If the H2 value is higher than 12, an account must be given of the development tendency of the H2 value.

If a tenderer is a working partnership (supplier consortium), the requirements apply for each of the participants.

The H2 value is defined as the number of work accidents with and without absence, divided by the hours worked multiplied by 10 to the power of 6.

Tenderers must be certified or in the process of being certified in accordance with ISO 14001 (2015), EMAS (EU Eco-Management and Audit Scheme for environmental management), or the Eco-Lighthouse certification scheme, with relevance for equivalent public transport projects.

Minste nivå(er) av standarder:

A list of up to 8 but no less than three contracts that the tenderer (or companies that the tenderer will rely on) has implemented or is implementing in the last 5 years, calculated from the submission deadline for participation in the competition. The list shall, c.f. the form included in chapter E, include the following for each of the contracts:

(a) tenderer's name;

(b) name of the recipient (contracting authority);

(d) description of the nature of the contract work, including the relevance as regards the qualification requirement;

(e) what works were carried out by the tenderer and what works were carried out by sub-contractors (contract facilitators);

(f) dates of delivery;

(g) contract value excluding VAT;

(h) the place where the project was carried out;

(i) reference person/contact person at the contracting authority with contact data (telephone number and email address), and a statement of the person in question's role during the contract.

Tenderers are responsible for ensuring that reference persons are available and will provide a reference.

The qualification requirement is to be documented through the list described above in point 2.4.1.

The contracting authority has the right to give weight to any of their own or other contracting authorities' experiences beyond the given references, positive and negative, with the tenderer and any cooperating companies, c.f. point 4, that are of relevance for assessing how the tenderer can be qualify.

1) Description of the tenderer's system for HMS.

2) Table of contents of the system.

3) Documentation of audits for recent years, with confirmation from the person/persons who have carried out the audits.

(a) Overview of the H2 value for the tenderer and central contract facilitators in the last 3 years.

(b) If the H2 value is higher than 12, an account must be given for the development tendency of the H2 value. Tenders must include a separate description of whether improvement measures have been implemented, and if available, documentation must be attached of the effect of the measures based on recent accident numbers.

For this tender conest, the contracting authority will select three to four qualified tenderers who will be invited to submit tenders and participate in the negotiations, c.f. chapter B3 of the tender documentation.

The selection of the tenderer will be based on the contracting authority’s evaluation of which qualified tenderer best fulfils the following selection criterium:

• the tenderer's technical and professional qualifications in accordance with qualification requirements, point 2.4.1 Relevant experience.

The assessment will be based on the documentation for similar qualification requirements, c.f. point 2.4.1 above.
