The contracting authority will utilise the access contract in situations where the regular transport/the RORO market is not able to satisfy the contracting authority's requirements to a sufficient degree. Typically, this can be situations with military or humanitarian/civil crisis. The tenderer accepts that the contracting authority can utilise the contract both in times of peace, crisis, conflict or war.

Secure access to the RORO capacity is part of the contracting authority's obligation to NATO. Therefore, the contracting authority may, in its sole discretion and at any time, choose to utilize the contract to make the capacity available to other NATO nations.

Registration in a trade register or a company register: tenderers must be registered in a company register or a trade register in the country where the tenderer is established. As described in annex XI of directive 2014/24/EU; suppliers from certain member countries can be required to fulfil other requirements in the mentioned annex.

Minimum qualification requirements: description of requirements/documentation: qualification requirements: the tenderer will be registered in a company register or trade register in the state where the tenderer is established.

Documentation requirements: Norwegian tenderers — company registration certificate.

Foreign companies: confirmation that the tenderer is registered in a company register, professional register or a trade register in the country where the tenderer is established.

Other requirements:

1) The vessel series must have its primary legal entity in a NATO or EU country.

Documentation requirement: certificate confirming where the vessel series has its primary legal entity.

2) The vessel must be legally registered in a NATO or EU country.

Documentation requirement: certificate confirming where the vessel is registered.

3) Ownership of the vessel must be monitored by an IACS.

Documentation requirement: certificate confirming that the vessel series is monitored by IACS.

4) Master and chief officers must have citizenship in NATO or the EU.

Documentation requirement: the vessel series must use a self-declaration to confirm that master and chief officers have NATO or EU citizenship.

5) Vessels must maintain all internationals laws and rules as well as the ISM, ISPS and MARPOL requirements.

Documentation requirement: vessel owners must be able to documents this with certificates/self-declaration.

6) The vessel must be registered under a flag state that fulfils the given ICS standard. See the Procurement Regulations point 5.2.1.

Documentation requirement: certificate confirming under which flag the vessel is registered.

7) The tenderer must be experienced with similar deliveries.

Documentation requirement: a reference list with a brief presentation of similar deliveries during the last three (3) years together with the name and position, telephone number and email address for the client's contact person. NDLO must be able to contact the reference person. The tenderer must inform the reference person of possible contact.
