Sandefjord Municipality uses the agreed seriousness provisions that have been worked out by Difi, Fellesforbundet, KS and Byggenæringens Landsforening. The seriousness provisions consist of 11 main points that tenderers must comply with: 1) HSE card; 2) Obligatory membership in StartBANK or an equivalent supplier register, 3) Skilled tradesmen are required; 4) Apprentices, 5) Reporting obligation to the Central Tax Office for foreign affairs; 6) Internal control. Safety, health and working environemnt (SHA); 7) Requirements regarding wages and working conditions; 8) Use of sub-suppliers, including hired labour; 9) Requirement for payments to a bank; 10) Breaches of contractual terms — consequences for future contests; 11) Audit. The requirements are in the contract requirements in the contest documents.

Sandefjord Municipality will establish a 4-year framework agreement for site gardening services and accompanying material. Start-up approx. 1 July 2020.
The annual value is estimated to be approx. NOK 1.5 — 3.0 million excluding VAT. The annual procurement volume will depend on activities, political decisions, the budget situation and other framework factors, thus it cannot be guaranteed in any way.
The accompanying material is an option that the municipality can choose to use. The municipality will decide in each assignment whether or not material is to be delivered with the site gardening services.
The aim of the contract is to meet the municipality's need for the procurement of site gardening services. The delivery includes different types of assignments within new sites, repairs and restorations of all types of outdoor installations, in accordance with the requirements set in this document and annexes.

Major procurements (value above NOK 500 000) can be kept outside this contract if the contracting authority wants to do this. The contract suppliers will be invited to participate in such contests.

Requirement 1: tenderers must be registered in a company register or trade register in the member country where the tenderer is established. Documentation. Norwegian companies: company registration certificate from the Register of Business Enterprises. Foreign companies: proof that the company is registered in a trade or business register as prescribed by the law of the country where the tender is established.

Requirement 2: payment of public fees. Norwegian tenderers must present a tax and VAT certificate by the tender deadline that is not older than 6 months calculated from the tender deadline. Tenderers must not have substantial arrears. Any arrears must be justified separately.

Foreign tenderers must submit proof that the company has fulfilled its obligations regarding the payment of social security contributions and duties in accordance with the legal provisions in the country where the tenderer is established, or in Norway. A certificate issued by the relevant authority in the tenderer's home country will be seen as adequate. If a tenderer's home country does not issue such documents or certificates, they can be replaced by a declaration given under oath or affirmation by the relevant person to a legal or administrative authority, a notarius publicus or other competent authority in the home country.

Requirement 3: tenderers are required to have adequate financial ability to fulfil the contract.

Documentation 3: presentation of the company's annual accounts (the most recent annual report submitted to the Brønnøysund Register of Enterprises, including the auditor's report). Newly established businesses must submit a recent financial printout signed by the auditor.

Teknisk og faglig kapasitet:
Requirement 4: a good and well-functioning quality assurance system is required for the services that will be provided. The concept quality management system means that the tenderer has a consciousness in relation to e.g. quality objectives, planning, securing, treatment of non-conformance and quality improvement.

Requirement 5: tenderers are required to be environmentally conscious when sorting their waste.
Requirement 6: tenderers are required to have experience and good references from equivalent assignments.
Requirement 7: a good ability to fulfil the contract is required. Tenderers must have sufficient personnel, machines and equipment available for the assignment.

Documentation 4: statement of the tenderer's quality assurance system.
Documentation 5: documentation: tenderers must provide a description of their waste plan.
Documentation 6: tenderers must give a list of their most important relevant deliveries in the last 3 years, including a description of the assignment (what it involved), information on the contracting authority, value, date, and the contracting authority's contact person (name, telephone number and email address). Sandefjord Municipality will also be able to place emphasis on its own experience with the tenderer.

Documentation 7: a description of manpower (including competence and experience), machines and equipment that the tenderer has available for fulfilment of the contract, whether they belong to the company or not.
As regards manpower, a minimum of 1 person at the tenderer must have a certificate of apprenticeship as a site gardener. As regards machines and equipment, tenderers must document, as a minimum, that they can use and have the required qualifications (certificate/competence) to handle the following types of relevant machines and equipment: Excavators 8 to 12 tonnes, mini-excavators, tractors with loaders and trailers, compressing equipment, cutting equipment, soil preparation equipment.
