Norwegian Ministry of Foreign Affairs

The purpose of the agreement is to provide parts of the norwegian foreign service with internal communication via global VSAT. The services must comply with the the Ministry’s requirements for stability, quality and capacity. Further the purpose of the agreement is to ensure flexibility to decrease or increase the number of foreign missions that is included in the agreement.
The agreement concerns all phases in the life cycle from planning, deployment and testing, via ongoing operations, to termination.

The Customer has a unilateral right to prolong the agreement 4 times, each time for a period of 1 year.
Beskrivelse av opsjoner:
1) Option on prolongation as described under duration of the agreement;
2) Option to purchase supplier-owned antennas at the end of the agreement.

Vilkår for deltakelse
Egnethet til å utøve yrkesvirksomheten:
The service provider must be registered in a business register, professional register or trade register in the state the service provider is established.
Økonomisk og finansiell stilling:
The service provider must have sufficient economic and financial capacity to carry out the contract.
Minste nivå(er) av standarder:
A) The service provider must have a relevant liability insurance;
B) The service provider's average turnover for the last 3 completed financial years within the scope of this contract must exceed 540 000 000 NOK;
C) The service provider must at least have a credit rating “Creditworthy without collateral” or equivalent.
Teknisk og faglig kapasitet:
The service provider must have sufficient technical and professional competence, organization and capacity to ensure high quality in the execution of the services in the duration of the contract.
Minste nivå(er) av standarder:
A) The service provider must be able to deliver VSAT connection to all eight locations;
B) The service provider must have carried out at least 3 relevant deliveries of comparable capacity, geographical coverage and scope over the past 3 years.

The VSAT procurement process has been cancelled pursuant to § 25-4(1) of the Public Procurement Regulations. The reason for the cancellation is related to the mandatory condition for participation that qualified suppliers must have a minimum turnover of 540 000 000 NOK, cf. “Invitation to request for qualifying”, Section 5.3.2 “Economic and financial capacity ability”. An incorrect minimum amount of 540 000 000 NOK was published due to a misprint. The maximum contract value was initially estimated at 220 000 000 NOK. Thus, in accordance with the Public Procurement Regulation § 16-3(1)(a), the minimum turnover demand should have been an amount no higher than twice the maximum estimated contract value (440 000 000 NOK). The possibility that the published amount 540 000 000 NOK may have caused interested suppliers to abstain from further interest in the procurement of global VSAT services cannot be completely excluded. As this error by jurisprudence is considered to constitute a material breach of the public procurement regulations, in particular § 16-3(1)(a) and taking into consideration that such material breach cannot be rectified by an additional announcement or additional notification, we regret have to cancel the present procurement process for global VSAT services.
