The tenderer is a legally established company.
Documentation Requirement:
1) Norwegian companies: Company registration certificate;
2) Foreign companies: Proof that the company is registered in a trade or business register as prescribed by the law of the country in which the tenderer is established.
Økonomisk og finansiell stilling:
The tenderer must have sufficient economic capacity to implement the contract, including amongst other things, the following will be considered/evaluated:
— the tenderer's credit rating, minimum A,
— the tenderer's positive equity.

Documentation Requirement:
The Client will obtain a credit rating from Bisnode. The Client will assess the Annual Financial Statement as it is displayed in the KGV.
If in doubt, the Client can obtain further information from tenderers.
If a tenderer has valid reasons for not being able to provide the documentation requested by the contracting authority, the tenderer can document his economic and financial capacity by presenting any other document that the contracting authority deems suitable.

Tenderers must have the capacity to implement the contract.
Minste nivå(er) av standarder:
A brief description of three of the tenderer's most relevant (comparable) assignments during the last three years. The tenderer must highlight their competence and experience as well as the selection of technology, implementation method, size of the assignment and contract form, and the role of the tenderer in the assignment. It is the tenderer´s responsibility to document relevance in the description.

Justification for cancellation Refer to our letter of award of contract to Asplan Viak Internet dated 20.11.2019. Sweco Pavement Consultants AS appealed the award on 2.12.2019, demanding that the competition be cancelled. The appeal was rejected in a letter dated 5.12.2019. Thereafter, Sweco Pavement Consultants AS then brought a case for interim injunction before the Drammen District Court, claiming that Buskerud county should be prohibited from entering into a competition until a legal decision is made whether to set aside the award of contract. Spoken negotiations were held in Drammen Courthouse on 17.12.2019 and the court issued a ruling the case on 20.12.2019. The Courthouse rejected the claim from Sweco, and upheld Buskerud county's decision not to uphold the injunction. Therefore, the contracting authority can enter into a contract with Asplan Viak Internet AS. However, the Court rulings contain statements that relevant counties through future call-offs on the framework agreement could undertake illegal direct procurements. The reason for this view is that the other counties are not clearly identified in the announcement, cf. the Procurement Regulations § 26-1 (3). The court's preliminary assessment of the identification requirement is, according to the contracting authority's opinion, too strict. However, the contracting authority considers the risk for process and delays to be so large that the cancellation of the competition is considered to be most appropriate. There is, thus, justifiable reason for cancellation. The contracting authority therefore cancels the competition with immediate effect cf. The Procurement Regulation § 25-4.
