Sub-tenders

Tenders cannot be submitted for parts of the assignment and alternative tenders are not allowed. The contracting authority has considered dividing up the assignment in accordance with the Utilities Regulations §15-3, but has decided that this is not suitable for this type of contract.

The contracting authority reserves the right to accept all or parts of a tender.

Contract NS8401

Contract period: the contract is expected to be signed on 1.2.2020 with an immediate start-up. The final date will be 31.12.2021 at the latest. The contract sum is not subject to regulation.

Contract terms. The contractual relationship will be regulated by NS 8401:2010, with the accompanying standard contract terms for the contracting authority (contract, other contract terms). The tender documentation annex is part of the contract documentation. Tenderers must familiarise themselves with all the contract terms.

Building form 8401 must be used. The following has been decided: Point 2: Tender documentation and annexes are part of the contract documentation - Point 3: See the tender documentation, points 1.1.3 and 2.1 — Point 11: Alt.1. Liability for compensation must comply with the terms in NS8401 point 13.3.

Right to accept responsibility and special terms. It is the tenderer's responsibility to ensure that they fulfil the relevant requirements in the law and regulations for the management system and have competence within fields affected by the contract work, either in the form of central certification or a declaration of the right to be responsible within relevant fields, or in the form of central certification or a declaration of the right to be responsible for general responsibility. It is the tenderer's responsibility to ensure that any sub-suppliers without an independent right to be responsible fulfil the requirements in the law and regulations.

The contracting authority expects that the tenderer studies the contractual terms and makes the required internal clarifications in such a way that a contract can be signed if awarded.

Økonomisk og finansiell stilling:

Tax and VAT certificates

Tenderers must have their tax and VAT payments in order (ESPD: Part II A.e).

Documentation requirement: requirement for certificate of paid VAT, tax and social security contribution. A certificate issued by the competent authority in the tenderer's country, confirming that the tenderer has met their obligations in regard to payment of VAT, tax and social security contributions in the country where the tenderer/contractor has their headquarters the (Norwegian certificate for Tax and VAT is combined and ordered from altinn.no, previously RF-1244) in accordance with the legislation in the country. The certificate must not be more than 6 months old.

This also applies to any sub-suppliers that are needed to fulfil the contract.

This requirement only applies to Norwegian tenderers, cf. PPR §7-2.

Other economic and financial requirements: economic and financial standing

Requirements regarding the tenderer's economic and financial standing: the financial capacity to fulfil the contract is required (ESPD: Part IV B.58-3).

Documentation: the contracting authority will assess finances through the company and accounting information system Proff Forvalt (www.forvalt.no). The contracting authority reserves the right to obtain supplementary information about the tenderer's finances.
