This framework agreement will deal with assignments for maintenance, operations, construction and assembly of street lighting for 8 municipalities in Rogaland in accordance with fixed plans and individual call-offs. Parts of the contract work will also include engineering design and construction of new installations. This will also include establishment of a contingency contract in a fixed guard scheme together with the contracting authority.

Økonomisk og finansiell stilling:

The tenderer must have the financial capacity to implement the contract. The tenderer must be credit worthy without the requirement for security.

Minste nivå(er) av standarder:

Credit evaluation/rating, not older than 6 months, and which is based on the last known accounting figures. The rating shall be carried out by an officially certified credit rating institution. If for justifiable reasons, the tenderer cannot prove his financial position in accordance with the above mentioned documentation requirements, the contracting authority will assess other suitable documentation, for example, a declaration from a financial institution of surety.

Teknisk og faglig kapasitet:

Public and private infrastructure for lighting.

The current installations have competence requirements concerning FEF (Regulations on Electrical Supply Installations) as well as NEK (NN). Tenderers must document competence and experience with comparable assignments.

The tenderers must have experience from assignments of an equivalent nature, size/scope and degree of difficulty.

Minste nivå(er) av standarder:

Information about education and professional qualifications of the tenderer and the tenderer's administrative management (competence matrix).

An overview of assignments carried out during the last 5 years, together with attestations of satisfactory execution for the 3 primary works. The attestations must state the value, dates and location the work was performed and indicate whether the works were professionally and properly completed. Information about the reference person must be provided and the builder must be given full authority to contact them.

Information about education and professional qualifications (CV) for the offered project organisation, i.e. project manager assignment manager/site manager/foreman/engineering design manager/QA manager/SHA manager.

Competence must be documented by providing CVs for the personnel intended to serve the contracting authority. Tenderers must document that the intended personnel are authorised installers for this type of work.

Note 1: Due to the nature of the assignment, it is important that executing personnel have local knowledge of the geographical work area this contract will cover.

The tenderer must have sufficient capacity and implementation ability (capability) to ensure smooth and safe delivery and contingency during faults.

A statement of the tenderer's average workforce and the number of employees in the administrative management in the last 3 years (can be the same document as the expertise matrix).

The tenderer must present a statement of how they will secure sufficient capacity for this assignment.

Amongst other things, a staffing plan must be enclosed, stating the number of own employees, hired, sub-contractors, etc. for the equipment, machines, tools, materials or technical equipment that the tenderer has at disposal for the implementation of the contract. With regard to emission-free vehicles, separate transitional provisions have been given in Appendix A Section 3.5, Environment.

Vilkår for kontraktoppfyllelse:

The company must meet the statutory requirements in Norway pertaining to health, environment and safety, as well as have an internal control system.

Tenderers must have environmental competence suitable for the contract work. Amongst other things, there are requirements regarding zero emissions vehicles to be used for the fulfilment of contract work for the municipalities within certain limits and with given transitional arrangements.

The contracting authority plans to invited 5 to 7 service providers to submit tenders. If more than 7 qualified service providers submit a request for participation in the competition, the contracting authority will choose from these service providers on the basis of the selection criteria in point 3.4. All service providers who are invited to submit tenders will have their tender evaluated.

The contracting authority reserves the right to reduce the number of tenders before the first negotiation round (prior to) and during the process (negotiations in several phases). This type of reduction will occur based on an evaluation of the tender compared to the award criteria further described in point 5 of this tender documentation.

An invitation to participate in the competition is announced in the DOFFIN and TED database through this notice.

The competition will be implemented as a limited competition with a qualification phase where the suppliers submit a request to participate in the competition. Only service providers who fulfil the qualification requirements in the competition will be invited to submit a tender. These qualified service providers will be invited to submit tenders for the contracts. The competition will be implemented through the contracting authority's (Lyses AS’) request portal https://procurement.lyse.no/ece/.

In accordance with the Public Procurements Act, other service providers who are not awarded contracts have a deadline to request a temporary injunction against the contracting authority's award decision. This waiting period has a duration of 10 days after notification of the award has been given. Contracting authority's cannot sign a binding contract with selected tenderers until after this deadline has expired.

Any complaints must be dealt with internally before the contract is signed. If the complaint does not proceed, the complainant has the opportunity to appeal the decision to the Public Procurement Complaints Board (KOFA), cf. the Public Procurement Regulations. Please contact the contracting authority's contact person as needed for further information about the case, and the contracting authority will provide feedback as soon as possible.
