The contracting authority only received ‘unacceptable tenders’ and therefore decided to use the opportunity to invite all qualified tenderers to negotiations, cf. the Public Procurement Regulations § 13-3 (1), letter a, cf. § 13-2, letter e. The received tenders were unacceptable as they contained discrepancies from the contract documents, and the discrepancies were not insignificant. A new call for tenders was not published at Doffin/TED, it was only made available to qualified tenderers.
