Folkehelseinstituttet [the Norwegian Institute of Public Health] is implementing an open tender competition for the procurement of vaccine against rota virus for the base vaccination of infants in the Norwegian child vaccination programme, starting up in Q2 2019.
The competition is carried out as an open competitive tender, a one step process where all interested suppliers may submit a tender. Negotiations are not allowed. The objective of the procurement is to enter into a contract for the delivery of the rotavirus vaccine for base vaccination of infants in the Norwegian Child Vaccination Programme. The start of vaccination under the new agreement is anticipated to occur in Q2/Q3 2019.

The tenderer shall be registered in a company register, professional register or a trade register in the state where the tenderer is established.
Documentation requirement:
Norwegian tenderers: Company Registration Certificate.
Foreign tenderers: Verification showing that the tenderer is registered in a company register, professional register or a commerce register in the country where the tenderer is established.

Requirement: The tenderer shall have sufficient economic and financial capacity to be able to fulfil the contract. Creditworthiness with no requirement for guarantees will be sufficient to meet the requirement.

Requirement: The tenderer shall have experience from comparable assignments.
Documentation requirement:
Description of the tenderer´s up to 3 most relevant contracts in the course of the last 3 years. The description must include an indication of the assignment product/scope or value, dates and recipients.. It is the tenderer´s responsibility to document relevance through the description.

Requirement: The tenderer shall have sufficient delivery capacity throughout the contract period.
Confirmation that the tenderer has the capacity to deliver a sufficient number of doses of the rotavirus vaccine to fulfil the contract.
Requirement: The tenderer shall have the requisite permissions to be able to fulfil the contract.
If the tenderer is the manufacturer of the vaccine, permission must be presented from relevant EU/EEA authorities to manufacture pharmaceuticals.
If the tenderer is not the manufacturer of the vaccine, the requisite permissions from relevant EU/EEA authorities to trade in pharmaceuticals must be presented. (NOTE: The documentation requirement continues on the next page).
If the tenderer imports the vaccine, the import license that includes the offered vaccine must be presented.

Kontraktutførelse
Vilkår for kontraktoppfyllelse:
— The Norwegian Institute of Public Health requires ethical and socially responsible production. (Supply Agreement, point 10, 10.1 – 10.4),
— The tenderer shall be a member of the Legemiddelansvarsforeningen [Pharmaceutical Liability Association] (Supply Agreement, point 9.2),
— Folkehelseinstituttet [the Norwegian Institute of Public Health] can re-sell, non-distributed, vaccine doses (Supply Agreement, point 15.1),
— First delivery: A sufficient number of doses necessary to complete immunisation of 15 000 infants by 31.3.2019 (Supply Agreement, point 3.6),
— The tenderer is obligated to deliver the necessary number of doses to complete immunisation of 65 000 infants per calendar year. (Supply agreement point 3.3),
— Folkehelseinstituttet [the Norwegian Institute of Public Health] is obliged to purchase a minimum volume of the sufficient number of doses necessary to complete immunisation of 50 000 infants per calendar year during the agreement period. (Supply agreement point 3.2).

The competition must be cancelled due to an error in the tender documentation.
The Contracting Authority has reviewed one of the competition´s minimum requirements on the vaccine´s resistance against raised temperatures.
The minimum requirement is set to prevent unnecessary wastage due to minor temperature deviations. There are always requirements for procurements for the child vaccination programme that the vaccines in question must have a certain resistance against raised temperatures. Just how long a vaccine must be able to tolerate raised temperatures is assessed from procurement to procurement. In this procurement, the minimum requirement should have been set to 48 hours at minimum 25

The public procurement regulations (FOA) §14-2 (1) allow a Contracting Authority to make insignificant corrections, supplements and changes to the tender documentation.
The Contracting Authority is of the opinion that a change to one of the minimum requirements is to be seen as a significant change, as the change can affect participation in the competition. Any softening of the relevant minimum requirements within the announced competition would, therefore, be illegal.

Furthermore, the Contracting Authority is of the opinion that the only way to correct the error is to cancel the competition and then announce a new competition with the revised competition basis.
Pursuant to PPR § 25-4 (1) a Contracting Authority can cancel the competition with immediate effect if there is justifiable cause.
As the Contracting Authority has made an error that could limit the competition unnecessarily and which cannot be corrected in any other way, the Contracting Authority deems the justifiable cause requirement to be fulfilled.
The competition is cancelled and the Contracting Authority will announce a new competition.
