Grimstad municipality, hereafter called the Contracting Authority, invites tenderers to an open tender competition for the procurement of the following:

Framework Agreement with 1 tenderer for the procurement of a certified company health service in accordance wtih the law on working environment, working hours and employment protection.

(the Working Environment Act), LOV-2005-06-17 nº 62.

Legal basis: The procurement will be made in accordance with the Public Procurement Act LOV-2016-06-17 nº 73 and the public procurement regulations FOR-2016-08-12 nº 974.

The procurement is calculated to be above the EEA threshold and the competition will be held in accordance with public procurement regulations Part I and Part III, cf. the public procurement regulations § 5-1, 3

Requirement: K1:

Tax certificates: Tenderers shall not have significant unsettled obligations regarding the payment of taxes and duties.

Documentation requirement: Tax and VAT certificates. The certificates must not be older than 6 months from the deadline for receipt of tenders.

Requirement: K2:

Company Registration Certificate: Tenderers shall be a legally registered company.

Documentation Requirement: The tenderer shall enclose a certificate of registration in the branch register or company register as determined by the legislation in the country where the tenderer is established, e.g. the Brønnøysund Register Centre.

Økonomisk og finansiell stilling:

Requirement: K3:

Tenderers must have sufficient economic and financial capacity to fulfil the contract. The below minimum requirements must be met.

Requirement: K6:

Insurance Tenderers shall at all times establish/have insurance that is sufficient to cover the requirements from the Contracting Authority or third party due to the tenderer’s responsibility or risk in accordance with the agreement.

Documentation requirement: Tenderers must enclose a copy of an insurance certificate.

Tenderers must have sufficient economic and financial capacity to fulfil the contract. The following subrequirements must be met:

1) Minimum turnover: Tenderers must, in the latest 3 financial years, have a minimum annual turnover of 12 000 000 NOK excluding VAT.

Documentation requirement: Tenderers must enclose auditor approved annual accounts for the last 3 years.

2) Tenderers must be credit worthy and achieve a minimum level of “Decision Score 3” in the Contracting Authority's credit analysis tool www.bisnode.no

Decision Score calculates the probability of irrecoverable losses such as; commencement of bankruptcy proceedings, forced liquidation, insolvency and any complusory composition in a company 12 months into the future.

Documentation requirement: The Contracting Authority will analyse Norwegian tenderers' credit worthiness itself. The analysis will be based on the last available financial year that is in the analysis tool.

Certifications: The below minimum requirements must be met.

Requirement: K5:

Tenderers must have broad experience in providing good company health services to municipal entities. Documentation requirement: Tenderers must enclose an overview of the most representative company health services provided to municipal entities in the last 3 years. The overview shall show; the number of years the service has been provided, contract value, municipality name and necessary contact information in each respective municipality that the Contracting Authority can contact for further information on the service provided.

Kontraktutførelse
Vilkår for kontraktoppfyllelse:

The Framework Agreement duration is 4 years. The Agreement can be terminated by the parties with 2 months notification.

Call-offs are made of the Framework Agreement according to the terms in the Framework Agreement with associated annex. The Contracting Authority has no obligation to award assignments according to the Framework Agreement nor to purchase a minimum volume of assignments or services from the Tenderer.
