The aim of the procurement is to enter into a contract for the operation of the national road ferry route

Molde – Vestnes. The contract period is from the date the contract is signed until and including 30.6.2029. The operational period will be from 1.1.2021 up to and including 31.12.2028.

The contracting authority will enter into a contract for the route. The contract type is gross contract. See the tender documentation for further details on the extent.

Beskrivelse av opsjoner:

The contracting authority has an option to extend the contract and operational period for up to 36 months, based on the same terms as stated in the contract.

The contracting authority has an option for putting a back-up ferry into a permanent route.

Vilkår for deltakelse
Egnethet til å utøve yrkesvirksomheten:

Requirement 1:

Tenderers must be up to date with tax and duty payments.

Documentation requirement 1:

— Tax and duty certificate, not older than 3 months calculated from the tender deadline.

Norwegian tenderers: The certificate can be ordered Altinn.

Foreign tenderers: Certificates issued by competent authorities, confirming that the tenderer has met their obligations in regard to the payment of taxes and duties in accordance with the legal provisions in the country where the tenderer is established.

If the authorities in the relevant country do not issue such certificates, the tenderer must submit a statement that verifies that all taxes and duties have been paid. The statement must be issued by a legal or administrative authority in the home country or the current country of residences, or be approved and signed by an independent 3rd party The statement must be in Norwegian or English.

The certificate(s) must not be older than 3 months, calculated from the tender deadline. The documentation must be in Norwegian or English.

Requirement 2:

The tenderer shall be a legally established company.

Tenderers who apply on behalf of companies that are being established must enclose the formation document.

Documentation requirement 2:

Norwegian tenderers:

— Company registration certificate issued by the Brønnøysund Register Centre (not older than 3 months calculated from the tender deadline). The company registration certificate can be ordered via Altinn.

Foreign companies:

— Registration certificates in professional registers as determined by legislation in the countries in which the tenderer is established (not older than 3 months, from the tender deadline).

— Tenderers must state the company´s ownership arrangments.

Companies being established must submit a foundation document.

Requirement 3:.

Tenderers must have good conduct.

Documentation requirement 3: Completed documentation in the ESPD form, cf. point 6.1

Requirement 4:

Tenderers must have a valid certificate for safety management (Document of Compliance, DOC) for the operation of ro-ro passenger ships (ro-ro ferries).

Documentation requirement:

— Copy of an issued Document of Compliance, DOC

If the tenderer himself does not have an DOC certificate, but has delegated this to a management company that has a DOC certificate on behalf of the company, the tenderer must attach annex 5 Commitment Statement and a copy of the management company´s DOC certificate.

Økonomisk og finansiell stilling:

Requirement 5 (1):

Tenderers must have sufficient financial strength to fulfil the contract throughout the contract period.

Documentation requirement 5 (1):

— Annual Financial Statements with notes, including the Board's annual report and audit report for the last 3 completed years.

— Completed annex 1 Key Figures, overview of key figures based on the accounting figures for the last 3 years.

The contracting authority will itself obtain a credit rating/rating report of potential tenderers from an independent credit rating company and, if necessary, also for any sub-suppliers or cooperating companies.

Requirement 5 (2):

Tenderers must be able to get surety from a bank or financial institution in Norway, or an equivalent concession given within the EEA area.

The guarantee must cover every financial liability that the tenderer can have towards the Contracting Authority. The guarantee must be valid from when the contract is signed until 6 months after the contract has expired.

Documentation requirement 5 (2):

Confirmation from a bank, insurance company or other credit institution with certification for banking and financial activities by the Financial Supervisory Authority of Norway, or equivalent concession given within the EEA area that surety will be provided as stated in point 1.3 of the contract.

Requirement 6:

Tenderers must have an accounting division between outsourced and shielded activity.

Requirement 7:

Tenderers must fulfil all the terms for obtaining a Licence for scheduled passenger transport by vessel, cf. the Professional Transport Regulations § 4 and §§ 6-10.

Documentation requirement 7:

— Police certificate for the manager.

— Confirmation of a licence guarantee from a bank or insurance company for 9 000 EUR for a licence for the first vessel and Euro 5000 for a licence for each additional individual vessel, cf. the professional transport regulations § 7. (The value of the EUR will be determined for a period of 1 year. In the period 1.1.2018 — 31.12.2018, the guarantee sum is set to 84 000 NOK for the first vessel and 47 000 NOK for subsequent vssels in each licence category.)

— Certificate from the bankruptcy register, not older than 3 months calculated from the tender deadline.
