The aim of the procurement is to get an operator who can operate.
The county road ferry routes:
Sølsnes — Åfarnes for the period 1.1.2022 — 31.12.2033.
Aukra — Hollingsholmen, Mordalsvågen — Solholmen, Molde — Sekken for the period 1.1.2020 — 31.12.2033.
A contract will be signed for the entire Assignment.
There will be requirements regarding the maximum environmental impact on the Sølsnes — Åfarnes and Aukra — Hollingsholmen routes, see the procurement documents for further information.

Juridisk, økonomisk, finansiell og teknisk informasjon
Vilkår for deltakelse
Egnethet til å utøve yrkesvirksomheten:
Requirement 1: Tenderers must be up-to-date with tax and duty payments.
Documentation requirement:
— tax and duty certificate, not older than 3 months calculated from the tender deadline.
Norwegian tenderers:
The certificate can be ordered via www.altinn.no
Foreign tenderers:
— Tenderers must submit certificates issued by competent Authorities, confirming that the Tenderer has met their obligations in regard to the payment of taxes and duties in accordance with the legal provisions in the country where the Tenderer is established. The certificate(s) must not be older than 3 months, calculated from the tender deadline. The documentation must be in Norwegian or English.

Requirement 2: Tenderers must be a legally established company.
Norwegian companies:
— company registration certificate issued by the Brønnøysund Register Centre (not older than 3 months calculated from the tender deadline). The certificate can be ordered via www.altinn.no
Foreign companies:
— registration certificates in professional registers as determined by legislation in the countries in which the Tenderer is established (not older than 3 months calculated from the tender deadline).
If a Tenderer is owned 50% or more by another company or several companies belonging to a group, the equivalent information as requested in requirement 2 shall be provided for them or the parent company.
Requirement 3: Acommitment statement must be attached to the tender if several tenderers submit a joint tender.

The commitment statement shall clearly state the parties' inner responsibilities and division of assignments between them. The agreement shall state that the parties are joint and severally liable for fulfilling the contract with the Contracting Authority.

The Agreement shall nominate the company that shall represent the parties to the Contracting Authority. The contract must be signed by the tenderer who shall represent the parties.
The following documentation requirements apply if several tenderers submit a joint tender.
All the affected parties must present all the requested documentation for fulfilment of the qualification requirements with the exception of:
— qualification Requirement 4 (2) Pledge of a Demand Guarantee: a pledge must be provided for a Demand Guarantee,
— qualification Requirement 5 Pledge of a Licence Guarantee: the companies must provide a pledge for a licence guarantee in accordance with the cooperation agreement.
The cooperating companies will be assessed as one as regards the cooperation agreement for questions related to technical and professional qualifications and economic and financial capacity.
Økonomisk og finansiell stilling:
Requirement 4 (1): Tenderers must have a financial standing that enables them to fulfil the Contract for the entire contract period.
Documentation requirement:
— annual Financial Statements with notes, including the Board's annual report and audit report for the last 3 years (2015, 2016 and 2017),
— completed Annex 2, overview of key figures based on the last 3 years accounting figures:
If a Tenderer is owned 50% or more by another company or several companies belonging to a group, the equivalent information requested in requirement 4(1) shall be provided for them or the parent company.
Additional information:
The tenderer finds necessary to give in order to substantiate the financial position shall be attached the tender without request from the Contracting Authority.
The Contracting Authority will itself obtain a credit rating / rating report of potential tenderers from an independent credit rating company and, if necessary, also for any sub-suppliers or cooperating companies.
Requirement 4 (2): Tenderers must have a financial standing that enables them to fulfil the Contract for the entire contract period.
Tenderers must present confirmation (completed Annex 3) from a bank or financial institution with an office in Norway with certification for banking and financial activities from the Financial Supervisory Authority of Norway, that they will provide a demand guarantee as stated in Annex 1.3 of the contract Guarantee Declaration Demand Guarantee (template),

The Contracting Authority draws attention to the fact that this is not a normal bank guarantee, but a demand guarantee.
The demand guarantee must cover every financial liability that the Operator can have towards the Contracting Authority. The demand guarantee shall be valid from when the contract is signed until 6 months after the Contract has expired. (This guarantee must not be confused with a guarantee connected to the Licence, which must be provided by the Licensing Authority for awarding a Licence — cf. § 7 in the Professional Transport Regulations).

Teknisk og faglig kapasitet:
Requirement 5: Tenderers shall fulfil all the terms for obtaining a Licence for scheduled passenger transport by vessel, cf. the Professional Transport Regulations dated 26.3.2003 nº 301 §§ 4, 6-10.
Documentation requirement:
— police certificate for the manager, cf. the professional transport Regulations § 6. This must not be older than 3 months,
— confirmation of a licence guarantee (completed Annex 4, confirmation of a licence guarantee) from a bank or insurance company for 9 000 EUR for a licence for the first vessel and 5 000 EUR for a licence for each additional individual vessel, cf. the professional transport Regulations § 7 (the value of the EUR will be determined for a period of 1 year. In the period 1.1.2018 — 31.12.2018, the guarantee sum is set to 84 000 NOK for the first licence and 47 000 NOK for subsequent licences in each licence category.),

Requirement 6: Tenderers must have relevant competence and experience.
— completed Annex 5 that shows the tenderer's 2 most relevant assignments in the last 5 years.
The form (Annex 5) must be filled in with information on:
The assignment's name, place of execution, the Contracting Authority with the name of a reference person, period, the assignment´s annual value, the number of man-labour years, the number of man-labour years from the company's own employees, the number of man-labour years from sub-suppliers, the name of sub-suppliers and a short description of the assignment.

The Contracting Authority reserves the right to obtain information from the Brønnøysund Register Centre and to contact the stated references.
Additional information the tenderer finds necessary to give in order to substantiate competence and experience shall be attached the tender without request from the Contracting Authority.
