The contracting authority would like tenders for the provision of legal consultancy services for the Section for User Financing in the Directorate of Public Roads, the Norwegian Public Roads Administration.

The procurement comes under 'special services' and comes under the public procurement regulations part II, jf. § 5-1 no. 2 letter b). The open tender contest procedure will be used, cf. § 8-3 and the contracting authority reserves the right to have a dialogue with suppliers, cf. § 9-3. See the tender documentation for further information. The competition has to be published in TED due to the procurement´s estimated value, cf. § 8-17 no. 4, cf. § 21-1. We have to use the form for an open tender contest, as the form for a tender contest is not available in TED.

The contracting authority would like tenders for the provision of legal consultancy services for the Section for User Financing (BFIN) in the Directorate of Public Roads, the Norwegian Public Roads Administration.
The framework agreement will be used by the Section for User Financing (BFIN). BFIN administers AutoPASS (http://www.autopass.no/), which is the Norwegian system for collecting toll money.
The toll money sector is changing its organisation, replacing its ICT systems and preparing GDPR. The Section for User Financing (BFIN) in the Directorate of Public Roads needs to strengthen its legal competence and capacity in order to carry out and document this work. In addition there can be other legal assignments for the toll money sector, for example, updating fare guidelines and the toll money hand book, in dialogue with representatives for BFIN.

Varighet: 12 måneder
Beskrivelse av fornyelser:
The Contracting Authority has the option to extend the contract by 6 months + 6 months so that the total possible agreement length is 2 years.

Vilkår for deltakelse
Egnethet til å utøve yrkesvirksomheten:
The tenderer must be a legally established company.
Tenderers shall confirm that they comply with this requirement when submitting their tenders.
Tenderers must present the following documentation proof if requested by the Contracting Authority.
Norwegian tenderers: Company Registration Certificate.
Foreign companies: Documentation proving that the company is registered in a trade or business register as prescribed by the law of the country where the tenderer is established.
Økonomisk og finansiell stilling:
Norwegian tenderers shall confirm that they fulfil their tax, payroll tax and VAT obligations.
Tenderers shall confirm that they comply with this requirement when submitting their tenders.
Tenderers must present the following documentation proof if requested by the Contracting Authority.
The certificate must not be older than six months from the tender deadline.
Foreign companies shall present certificates that substantiate the fact that the tenderer has met the obligations in relation to the payment of tax and duties.
Minste nivå(er) av standarder:
The tenderer must be in an orderly situation in terms of payment of tax, employer's National Insurance contributions and value-added tax.
Teknisk og faglig kapasitet:
Tenderers shall confirm that they comply with this requirement when submitting their tenders.
Tenderers must present the following documentation proof if requested by the Contracting Authority.
Tenderers must give an account of how sufficient capacity and implementation ability for this assignment will be ensured.
Among other things, a staffing plan should be submitted for the assignment, showing the number of employees, hired persons, etc.
Minste nivå(er) av standarder: Tenderers shall have sufficient capacity and implementation ability.
