Os kommune

The Contracting Authority would like to establish 3 parallel Framework Agreements with companies who can provide architect and engineering design services, provided that there are a sufficient number of suitable tenders from qualified tenderers in the competition.
The idea is that the Framework Agreements will cover most of the Contracting Authority´s continual need for architect and engineering design services. The Contracting Authority has the right, but is not obliged, to use the Framework Agreement. Os municipality can, thus, hold separate competitions for assignments when appropriate. Some assignments can also be carried out by the Contracting Authority.

The contract period will be valid from when it is signed until 31.12.2019. The Contracting Authority has an option to extend the contract subject to the same terms for 1 + 1 + 1 years, so that the total possible length of the contract is 4 years.

The Contracting Authority can give 3 months written notice on the contract. If the Contracting Authority does not want to use its right to extend the contract, written notification of this must be given to the tenderers. The options are to be considered to be taken up if the tenderers are not notified that the options will not be taken up.

Vilkår for deltakelse
Egnethet til å utøve yrkesvirksomheten:
Requirement: Tenderers must be registered in a company register, professional register or a trade register in the country where the tenderer is established.
NB: Several companies can submit a tender together as a group without having established a joint company by the tender submission date. In such cases the individual group participants must be legally established companies.
Documentation: Norwegian companies: Company Registration Certificate. Foreign companies: Verification showing that the company is registered in a company register, professional register or a trade register in the country where the tenderer is established.

NB: If several companies go together to submit a tender as a group, certificates must be enclosed for all the group participants.
Økonomisk og finansiell stilling:
Requirement: Tenderers must have sufficient economic and financial capacity to fulfil the contract.
Documentation: A credit assessment/rating, not older than 1 year, based on the last known accounting figures. The rating must be carried out by a credit information agency with permissions thereof.
NB: If several companies go together to submit a tender as a group, they can either provide documentation that each member of the group has the financial capacity, or alternatively the group participants can use one of the group participant's financial capacity, in this case the tenderer must document a financial position secure enough to carry all the group participants' liability under the contract. The tender must then clearly state that documentation is only provided for one group participant and that the other participants are using this participant's financial capacity. A signed declaration from the tenderer that shall fulfil the requirement for the entire group must be enclosed with the tender, with a declaration that the other participating companies can invoke its financial strength.

The group members will always have joint and several liability for all the obligations in the contract.
If the tenderer has valid reasons for not being able to provide the documentation requested by the Contracting Authority, the tenderer can prove his economic and financial position with any other document that the Contracting Authority deems suitable.

Minste nivå(er) av standarder:
Minimum requirement: The rating shall show a minimum grade/score of A according to Dun & Bradstreet´s scale (or an equivalent result on another approved agency's scale).
Teknisk og faglig kapasitet:
Requirement: Tenderers must have experience from assignments that can be compared, i.e., engineering design services for renovation projects and new buildings.
Documentation: A description of up to 3 of the tenderer’s most relevant assignments in the last 3 years. The description must include information on the contract value, date and recipient (name, telephone no. and e-mail address). It is, however, the tenderer´s responsibility to document relevance through the description. Tenderers can document experience be referring to the competence of the personnel that can be used for this project, even if the experience was acquired while the personnel was in the service of another employer.

Kontraktutførelse
Vilkår for kontraktoppfyllelse:
1.5 Amendment clause — municipality merger.
Os municipality will merge with Fusa municipality on 1.1.2020 and will become Bjørnafjorden municipality. If the option to extend the contract has been taken up, the contract will be transferred to the new municipal organisation on 1.1.2020.
The new municipal organisation will have a right, but not an obligation, to award assignments within the Framework Agreement, when this does not conflict with other ongoing contracts that were signed before the municipalities were merged.
