In this competition, tenderers are invited to submit tenders for two packages:
Package 1: The ferry routes Borgan — Ramstadlandet and Eidshaug — Gjerdinga.
Package 2: The fast boat route Namsos — Rørvik — Leka.
Tenderers can:
1) Submit a tender for only one of the packages;
2) Submit independent and separate tenders for each package;
3) Submit a combined tender for both of the packages. This requires that the tenderer also has submitted independent and separate tenders for each package (cf. B). If the same company has won packages 1 and 2, either as independent tenders (B), or as a combined tender (C), a joint contract will be signed for the packages.
The assignment will be regulated by the attached contract provisions, cf. the Procedure Rules, Point 1.5.
The routes must be operated from 1.2.2020 to 31.1.2024. The Contracting Authority has a unilateral option to extend the contract for up to 2 years (1 + 1).
The extent of, and requirements for, the delivery are detailed in Part B of the contract.

The fast boat route calls at Namsos, Jøa, Abelvær, Rørvik, Eidshaug, Fjølvika, Skei and Gutvik. The route also calls at Gjæslingan in the period 09.05 - 31.08. The current route calls at Nordøyan in the period 07.07 - 11.08, but the route is a commercial route and is not part of this tender.

The routes must be operated from from 1.2.2020 to 31.1.2024. The Contracting Authority has a unilateral option to extend the contract for up to 2 years (1 + 1), (cf. the Contract Part A “General Contract Terms”, Point 3).

Egnethet til å utøve yrkesvirksomheten:

Tenderers must have their tax, payroll tax and VAT payments in order. Documentation by: A tax certificate, not older than 3 months from the tender deadline. Any arrears or other irregularities must be justified.

Foreign tenderers:

The tenderer shall submit certificates issued by competent authorities, confirming that the tenderers have met their obligations in regard to the payment of taxes and duties in accordance with the legal provisions in the countries where the tenderers are established. The certificate(s) shall not be older than 6 months, calculated from the tender deadline.

The tenderers shall be a legally established company: Documented by: Company registration certificate. The certificate must not be older than 3 months, calculated from the tender deadline.

Foreign companies:

Proof that the company is registered in a trade or business register as prescribed by the law of the country where the company is established.

AtB informs that the competition has been cancelled with immediate effect. The competition will be re-announced shortly after the Contracting Authority has reviewed and quality assured the tender documentation.

AtB will give a brief justification for the cancellation below.

There was a contradiction between part B the delivery description and part B annex 5 quay data. According to part B the delivery description, points 3.2.1.1 and 3.2.1.2, the “heavy goods vehicles must be calculated with a weight of 50 tons”. This exceeds the capacity calculations set in part B annex 5 quay data for the ferry quay bridge, the load weight is limited to BK T8/40 and BK8. The heavy goods vehicle capacity requirement for the ferries is, therefore, set too high for the quay's carrying capacity. Based on this, the weight requirements in part B the delivery description, point 3.2.1 (for package 1) for heavy goods vehicles must be changed.

The Contracting Authority is only allowed to make limited changes to the tender documentation, including the requirement specifications, after the competition has been announced. The public procurement regulations, § 14-2 state that “Before the tender deadline expires, the Contracting Authority can make corrections, supplements and changes to the tender documentation that are not of a significant character”.

In this case, an absolute requirement must be changed in the tender documentation. It is, therefore, not unlikely that one or several tenderers have, as a result of the absolute requirement, not participated in the competition. The Contracting Authority has, thus, decided that it would be a significant change if the above-mentioned requirement was changed.

As the error cannot be corrected at this point in time, without making a significant change to the tender documentation, the Contracting Authority has no other choice than to cancel the entire competition. There is, therefore, a justifiable reason for the cancellation, cf. the public procurement regulations § 25-4.
