Anskaffelsens omfang
Kort beskrivelse:
The start of the express boat route is planned for 1.11.2017. The length will be the same as the construction period for the tunnel improvements, which is estimated to be approx. 18 months. The contracting authority has the option to extend the contract for up to 6 months, so that the total possible operational period is 24 months, calculated from 1.11.2017.

In the event of the construction period for the tunnel improvements being shorter than planned, the contracting authority reserves the right to give notice on the contract from 1.10.2018, with 3 months notice, c.f. C.2.5.
The contract's amount or value:
The contracting authority estimates approx. 2920 trips in the contract period, excluding the option period. The final amount will be determined by C.2.5 Contract Period and D.2.3.13 Timetable.
Number of tenderers:
For this procurement, a contract will be signed with one tenderer.
Further details of the procurement are stated in the Tender documentation part D ‘Description/Requirement Specification’.

Conditions and deviations to the tender documentation can lead to rejection. Instead of submitting a tender with conditions/deviations, tenderers ought to ask questions. c.f. point B.1.7 ‘Questions and answers in the notice period’.
Any conditions and deviations shall be clearly stated in the tender and precisely and clearly described in the tender letter, so that the Norwegian Public Roads Administration can assess the deviations without contacting the tenderer.
If the tender does not include a clear and precise description, the consequence can be that the tender is rejected. Another possible consequence is that the deviation/condition cannot be asserted when carrying out the delivery (see the contract point C.2.1 on the order of priorities and dealing with any conflict).

Any conditions and deviations shall be priced as far as possible. Conditions or deviations that are not priced, will, if possible, be priced or judgementally assessed by the contracting authority when evaluating the tender.
A tenderer's referral to standardised delivery terms or similar will be regarded as a condition if the terms deviate from the existing competition or contract terms. Such referrals can, thus, lead to rejection.
The contracting authority has made the valid ESPD form available for tenderers together with the competition notice.
All tenderers who participate in the competition shall fill in and submit the form as provisional documentation that the qualification requirements are met and confirm that any other qualification requirements below are met on the date of the tender, c.f. the Public Procurement Regulations § 17-1 (2). The tenderer/s who are chosen to sign a contract must document fulfilment of the qualification requirements in accordance with the stated documentation requirements before the contract is signed.

The contracting authority can, at any time in the competition, request that tenderers submit the documentation proof stated in ESPD or the tender documentation otherwise, if this is necessary for ensuring that the competition is being held in the correct way, c.f. the Public Procurement Regulations § 17-1(3).

In addition to the documentation that the tenderer has submitted, the contracting authority will emphasise its own documented experience with the tenderer.
When the contracting authority requests documentation for fulfilment of the qualification requirements, the below documentation shall be presented.
Økonomisk og finansiell stilling:
Tax certificate
Tenderers must have their affairs in order with respect to the payment of tax, employer contribution and
VAT.
The chosen tenderer must present a tax and VAT certificate.
The certificate must not be older than six months from the tender deadline.
Foreign companies shall present certificates that substantiate the fact that the tenderer has met the obligations in relation to the payment of tax and duties.
Safety.
Tenderers shall provide surety for correct fulfilment of the Contract. The surety shall be provided at the latest [1 month after the Contract has been signed]. This security shall be for 10 % of the contract sum. This surety shall be valid until the Assignment has been completed.

Unless otherwise agreed in the Contract, the security from the Supplier is to be provided by a bank, insurance company or other credit institution that is approved by the contracting authority. Approval will be given by the contracting authority receiving the security from the Supplier for a check after the contract has been signed, but before the contract work starts.

Tenderers must have the financial capacity to fulfil the assignment.
The contracting authority will obtain a credit rating from Experian, if necessary also for any Sub-Contractors or collaboration partners, which will be based on the accounting figures from 2016.
In order to be qualified, tenderers must be assessed as credit worthy based on a point score in the credit rating. In case of any doubts or need, the last three years accounts will be assessed in addition.
Teknisk og faglig kapasitet:
HSE self-declaration. Completed and signed HSE self-declaration.
Tenderers shall fulfil all the required terms to having a licence for scheduled passenger transport by vessel, c.f. the professional transport regulations dated 26 March 2003 no. 401 §§ 4, 6-10.
— Certificate from the bankruptcy register, not older than 3 months calculated from the tender deadline.
— Police certificate, original copy, for the manager. The police certificate cannot be submitted electronically, it must be sent separately by the tender deadline.
— A guarantee pledge from a bank or insurance company equivalent to 9 000 EUR for one vessel and 5 000 EUR for each additional vessel.
Working partnership — statement of joint liability.
Where the tenderer is dependent on other service providers in order to qualify, a declaration of joint and several liability to the contracting authority and third parties must be submitted with the tender.
Furthermore, each individual participating company in the working partnership must provide information on their company, as is required in the tender documentation. Working partnerships will be assessed collectively for all the qualification requirements.

If a tenderer is dependent on a sub-provider in order to be qualified, the tenderer must document to the contracting authority that the tenderer will have the necessary resources at its disposal.
This can be documented by the tenderer presenting a commitment statement or equivalent.
