Qualification Requirement:

Tenderers shall be registered in a company register, professional register or a trade register in the country where the tenderer is established.

Documentation requirement:

Norwegian companies: Company registration certificate;

Foreign companies: Verification that the tenderer is registered in a company register, professional register or a trade register in the country where the tenderer is established. The certificate must not be older than 12 months from the tender deadline.

Qualification requirements:

Tenderers are required to have a quality assurance system.

Documentation:

Documentation of the quality assurance system. An account of the tenderer's existing routines and documentation that the requirement for the quality assurance system/management system that applies for the assignment is met. If this is described in the tenderer's quality assurance system, in accordance with ISO 9001 or equivalent, documentation of this can be enclosed.

Tenderers are required to have an environmental management system.

Documentation of an environmental management system. A copy of

any certificates, such as ISO 14001, EMAS, Miljøfyrtårn or equivalent, are to be enclosed. If a tenderer does not have an environment management system, the tenderer must be willing to implement one within 6 months of the contract being signed. This shall be documented in writing.

Tenderers shall have a binding cooperation relationship with any sub-suppliers.

Complete Annex 2 ESPD — section II D and the commitment statement. If a tenderer must rely on another company's competence or capacity to fulfil a qualification requirement, a separate ESPD form must be enclosed for this sub-supplier.

The public procurement regulations state that if a tenderer uses the capacity of other companies, he must document that he can use the necessary resources, for example, by enclosing a commitment statement (annex 11), cf. the Public Procurement Regulations § 16-10 (2). This provision applies in addition to the provision on the ESPD. If a tenderer will rely on the capacity of other companies, both an ESPD and a commitment statement (annex 12) must be enclosed for the relevant companies.

The tenderer must have the financial capacity to carry out the assignment/comply with the contractual obligations. Tenderers are required to be credit worthy and have satisfactory liquidity and solidity.

Documentation requirement: A credit rating based on the most recent fiscal figures. The credit rating must not be older than 3 months. The rating shall be carried out by a credit rating company with licence to conduct this service.

§ 25-2. Waiting period before the contract is signed.

(1) The contracting authority can enter into a contract after the waiting period has expired at the earliest, this period is determined by the contracting authority. The waiting period shall be at least 10 days calculated from the day after the notification on the chosen tenderer has been sent. If the contracting authority has made an exception from the requirement for using electronic communication, the waiting period shall be a minimum of 15 days.

(2) The waiting period requirement does not apply.

a) When the contracting authority does not have an obligation to announce the competition, jf. § 13-3 og § 13-4.

b) When the chosen tenderer is the only affected tenderer.

c) When the contracting authority awards contracts under a framework agreement.
