Framework agreement: — Name strips for the Norwegian Armed Forces

Forsvarets logistikkorganisasjon (FLO)

The aim of this procurement is to meet the users' need for name strips in the following varieties:
Approx. 2 000 sets per annum of name strips, white on blue (sea);
Approx. 10 000 sets per annum of name strips, black on green (army, home guard, air-force);
Approx. 2 000 sets per annum of name strips, brown on sand (INTOPS/Desert);
Name stripes are used by everyone in the Norwegian Armed Forces and Forsvarsmateriell who wear or use uniforms and other items provided by the Norwegian Armed Forces.
Most of the call-offs will cover crews who are called in for military service and they shall receive their name stripes shortly after arriving.

The framework agreement will last for three (3) years. The contracting authority reserves the unilateral right to extend the framework agreement 1 or more times up to a further 12 (twelve) months. The framework agreement's maximum length will be 4 years.

The tender contest is cancelled in accordance with the Public Procurement Regulations § 25-4 (1) regarding a justifiable basis for cancellation. Precedent from the Court of Justice of the European Union (CJEU) shows that erroneous procedures which cannot be corrected in any other way than by cancellation, may result in obligations to cancel. The obligation to cancel also presume that the inaccuracy may have affected the participation in the tender contest. The qualification requirement in the tender documentation to this tender contest is not a legal qualification requirement in accordance with the Public Procurement Regulations. The inaccuracy cannot be corrected in any other way than by cancellation. The alteration of the qualification requirement, after publication, is not legal in accordance with the Public Procurement Regulations § 14-2(1). The inaccuracy may also have affected the participation in the tender contest; potential suppliers may not have registered for participation due to the erroneous qualification requirements. The conditions for cancellation obligations are therefore met. The Contracting Authority must therefore cancel the tender contest. C.f. the Public Procurement Regulations § 25-4(1). A new competition will be published/announced shortly.
