Procurement of framework agreements for the purchase of moving services

The Agency for Nursing Homes currently has Several projects under way for the rehabilitation of existing nursing home buildings and erection of new construction for nursing home operations. When the buildings are ready for occupation, the operation of the selected nursing home shall be moved from the original building to a rehabilitated building/new construction. On this basis, there will be significant need for moving services for necessary fixtures and equipment. With a relatively large needs scope it would be practical to have functioning framework agreements for moving services.
The objective of the procurement is to ensure good processes for moving of necessary fixtures and equipment from the original nursing home to a rehabilitated building/new construction.
There will be a need for framework agreements with moving agencies that can execute the transposition of necessary fixtures and equipment. Call-offs on the framework agreements will including packing and unpacking of fixtures and equipment, transport of fixtures and equipment, as well as the necessary dismantling and reassembling of various equipment. For any dismantling and reassembling of equipment related to water/sewage there are requirements for formal competence to execute this, and the tenderer shall obtain the necessary help for this when they are unable to carry out the work themselves.
Currently the Contracting Authority is aware of four planned large moves. There will also be a need for various minor moves. Call-offs on two of the four known large moves must be anticipated to occur quickly after signing of the framework agreement.

Requirement: Tenderers shall be a legally established company.

Documentation requirement:

— Norwegian companies: Company Registration Certificate.

— Foreign companies: Proof that the company is registered in a trade index or business register as prescribed by the law of the country where the tenderer is established.

Økonomisk og finansiell stilling:

Requirement: Good solidity.

Documentation requirement: Credit evaluation/rating, not older than 6 months, based on the last known accounting figures.

Teknisk og faglig kapasitet:

Requirement: Good implementation ability.

Documentation Requirement: Overview of the company's total staffing and any sub-contractors.

Requirement: The tenderer shall have an internal control system that satisfied the requirements in all laws, regulations, instructions etc. that are applicable for the business.

Documentation Requirement: Copy of prevailing internal control system.

Requirement: The tenderer shall have experience from similar deliveries.

Documentation Requirement: The company's most important deliveries (not older than three years), including their value, dates, recipients/contracting authorities. References must be given, and the contracting authority has the authority to collect references if needed. When a reference person is contacted, it will be written in the minutes.

Kontraktutførelse
Andre særlige vilkår:

Ban on social dumping.

The tenderer is obliged to meet the requirements regarding payment and and working conditions in public contracts, dated 8.2.2008.

Return scheme.

If a Norwegian tenderer (manufacturer or importer) uses packaging, documentation must be submitted at the latest by the signing of the contract that confirms that the tenderer is a member of a recycling scheme or that they fulfil the obligations through their own recycling scheme with their own scheme for final treatment where the packaging is taken care of in an environmentally sound manner (Green Point Norway AS or a material recycling company).

Breaches of tax and duty obligations.

The tenderer and any sub-suppliers shall always fulfil their tax and/or duty obligations.

The contracting authority can always check the tenderer's and any sub-suppliers'fulfilment of tax and/or duty obligations.

If the tenderer, in a not insignificant degree, breaches his tax and/or duty obligations, the contracting authority can, after the tenderer has been given a deadline to correct matters, cancel the contract. If the tenderer significantly breaches his tax and/or duty obligations, the contracting authority can cancel the contract without the tenderer being given a deadline to correct matters. The right to cancel does not apply if the demand is formally disputed with a competent authority and the tenderer can substantiate to the contracting authority that the demand is not justified.

If the tenderer's sub-contractors significantly breach their

obligation to pay taxes and/or fees, the Contracting Authority can, after the sub-contractor is given a deadline to correct the breach, require that the tenderer replaces their sub-contractor as soon as possible, without cost to the Contracting Authority. The right to demand a replacement does not apply if the demand is formally disputed with a competent authority and the tenderer can substantiate to the contracting authority that the demand against the sub-supplier is not justified. If the tenderer does not replace the sub-contractor that they are obligated to replace, the Contracting Authority can cancel the agreement.

Breaches of the Competition Act.

If it is beyond reasonable doubt that the…

… tenderer has breached the Competition Act §§ 10 or 11, or equivalent provisions, the contracting authority can cancel the contract if this is deemed to be appropriate after a concrete assessment.c

… tenderer's sub-contractor has breached the Competition Act §§ 10 or 11, or equivalent provisions, the Contracting Authority can demand that the tenderer as soon as possible replace their sub-contractor, without cost for the Contracting Authority. The right to demand a replacement does not apply if the demand is formally disputed with a competent authority and the tenderer can substantiate to the contracting authority that the demand against the sub-supplier is not justified. If the tenderer does not replace the sub-supplier that it is obliged to replace, the contracting authority can cancel the contract.

Prior to cancellation, in accordance with the first section and before the demand to replace a sub-contractor in the second section, the Contracting Authority shall assess the time that has lapsed since the breach of the Competition Act §§ 10 or 11 occurred, what self-cleaning measures were implemented by the tenderer or sub-contractor and possibly other factors that can be of significance to the assessment of whether cancellation or replacement is relative. If the breach of the Competition Act has directly afflicted or affected Oslo municipality, cancellation will always be seen as proportional.
