Bergen Kommune (Bergen municipality)

Bergen kommune, Water and Sewage Authority (VAV), manages W&S installations that include over 100 km of
tunnels and caverns.
Since 2007, inspections have been undertaken for control and implement safety measures in order to ensure safety against debris and landslides in many of the installations.
The W&S installations in mountains consist of a treatment plant for waste water and associated supply tunnels, sewage and discharge tunnels, water treatment plants with pure water basins, and tunnels for supply and distribution to the consumers.
The treatment plans for waste water and water treatment plants consists of larger caverns with many installations and open basins that require extra measures and equipment in order to scale and secure the rock in the rooms.

Bergen kommune, c/o The Water and Sewage Authority, intends to enter into a framework agreement with one contractor for the execution of rock protection of the municipality's mountain installations. The framework agreement also includes protection measure in the open air by access roads and pithead installations (for example cliffs/cuttings).
Please note that also other authorities and department in Bergen kommune can utilise this framework agreement.

The total contract value including options is approx. 100 000 000 NOK.
Beskrivelse av opsjoner:
The framework agreement shall have a duration of 2 years, with an option for the Contracting Authority to extend the contract once or several times for a further 2 years, with a total maximum of 4 years. The Contracting Authority shall give notification of exercising options, at the latest 30 days before the end of the agreement period.

Vilkår for deltakelse
Egnethet til å utøve yrkesvirksomheten:
The tenderer shall have the tax, payroll tax and VAT payments in order.
Documentation:
Tax Certificates not older than 6 months calculated from the tender deadline.
Tax certificates are defined as:
For Norwegian tenderers:
· Tax certificate issued via Altinn, The Tax Office or
The Tax Collector Office.
· VAT certificate, issued via Altinn, the Tax Office or the Tax Collection Office.
For foreign tenderers:
· Foreign tenderers must submit equivalent certificates from their own country that show that their tax and duties payments are in order.
If the authorities in the relevant country do not issue such certificates, the tenderer shall submit a statement which verifies that all taxes and duties have been paid. The declaration shall be approved and signed by the tenderer's Financial Director/ person responsible for Finance.

The tenderer should meet Norwegian HSE requirements when performing work in Norway.
Filled in and signed HSE self-declaration in accordance with PPR Annex 2.
It is preferred that the tenderer use the attached template, see Annex 2.
The tender shall be a legally
established company.
Norwegian tenderers:
· Company Registration Certificate.
Foreign tenderers:
· Confirmation that the tenderer is registered in a trade register or company register in accordance with the law in the country where the tenderer is established.
Økonomisk og finansiell stilling:
The tenderer must have sufficient economic and financial capacity to fulfil the contract.
Documentation:
Tenderer can document their economic/financial capacity in the following ways:
· Credit rating report from a company that has a licence from the Norwegian Data Protection Authority to operate a credit information company in Norway, possibly from a company with equivalent certification in a member country of the EU/EEA. The credit rating report must be based on updated accounting information.

· Last year's approved Annual Financial Statement including the board's annual report and the auditor's statement. Recently established companies that cannot present approved annual accounts can submit the accounts that have been completed.
· Appropriate bank/parent company guarantees and/or relevant liability insurance. The Contracting Authority will regard bank/parent company guarantees or relevant liability insurance as suitable if these documents cover the Contracting Authority's financial risk where the tenderer does not have the financial or economic capacity to fulfil the contract. The Contracting Authority's financial risk means economic loss caused by non fulfilment of the contract. Parent Companies providing guarantees must document that they themselves comply with the requirement for ‘the company's solidity’.

The tenderer is free to provide other information that can be seen as relevant for the assessment of whether the requirement of the company's solidity is fulfilled.
The Contracting Authority reserves the right to obtain credit rating reports.
All the received and any obtained information will form the basis for an overall assessment of whether the qualification requirement is fulfilled.
Teknisk og faglig kapasitet:
Tenderer must document competence equivalent to central approval for the right of responsibility for the function of executor in enterprise classification 2: roads and ground works.
Documentation:
· Central approval for the right of responsibility for the function of executor in enterprise classification 2: road and ground works, or for equivalent relevant certification area.
· Documentation that the tenderer holds professional qualifications to be able to achieve central approval for the function of executor in enterprise classification 2: road and ground works.
The tenderer shall have experience from a minimum of three equivalent assignments during the last 3 years.
Equivalent assignments meaning that the tenderer must have experience from protection works in mountain installations where there are also requirements for safeguarding of the existing technical installations, for example the existing water and sewage pipes of different dimensions, fibre cables, pumps etc.

In addition, the tenderer must also have experience with protection works in mountains/open air cliffs with requirements for safeguarding of the existing buildings, structures, infrastructure etc.
Description of the tenderer's three most relevant assignments during the last three years. The description must include a statement of the contract's value, date and recipient (name, telephone number and e-mail address). References will be contacted if needed to clarify relevance of the assignment. However, it is the tenderer's responsibility to provide a description substantiating relevance.

Overview of the tenderer's total, available staffing in the specialist field of rock protection, as well as the equipment, machines, tools, materials or technical equipment that the tenderer has at their disposable for the execution of the contract/assignment.

The tenderer is required to have procedures and systems that ensure a low environmental impact from the execution of delivery.
Description of the company's procedures and systems for ensuring low environmental impact when carrying out the delivery.
If the company has environmental certification or ISO 14001:2004 (or a more recent version) or equivalent third party verified systems, such a certificate will be accepted as documentation for fulfilment of the qualification requirement.
Tenderers are required to have systems for quality management and effective flow of goods.
Description of the company's policy regarding quality management, with emphasis on quality assurance, resource management, management responsibility, manufacturing process and continuous analysis and improvement. If the tenderer holds an ISO 9001:2008 certificate (or newer version), such a certificate will be accepted as documentation of compliance with the qualification requirement.

If a tenderer will use other companies to be qualified in regard to the Contracting Authority's qualification requirements, tenderer must document for the Contracting Authority that the tenderer will have control of the necessary resources, for example by submitting a commitment statement about this from the companies.

For a company supporting the tenderer's fulfilment of the qualification requirements, such documentation must be submitted as required in the relevant qualification requirement.
Any sub-suppliers must have the necessary qualifications, and it is the tenderer's responsibility to ensure that sub-suppliers have these. If a tenderer uses a sub-supplier to be qualified, the documentation requirements in point 3.5 of the tender documentation also apply.

Objektive utvelgelseskriterier:
In accordance with the qualification documents' point 2.2 the number of tenderers invited to submit tenders will be limited. This limitation is carried out based on a ranking of the service providers.
Service providers will be ranked on the basis of the following qualification requirements:
· Requirement: Experience from equivalent assignments, cf. point 3.5.
· Requirement: Implementation ability and capacity, cf. point 3.5.
