The contracting authorities are Nordland, Nord-Trøndelag and Møre og Romsdal counties through the County North Collaboration (FKN). As FKN is not a legal entity, identical contracts will be established between the chosen service provider and each county.

Annex 7 only indicates the volume of procurements in 2014 and is not binding for the county. The county will be obligated to procure dental equipment, maintenance and service through this contract. The exception from this will be if the tenderer cannot deliver the wanted/equivalent equipment, parts or maintenance.

The contracting authority draws attention to the fact that the ongoing municipality reform and the notified region reform can lead to changes with municipalities and counties merging. Nord-Trøndelag and Sør-Trøndelag counties has, amongst others, decided to merge with effect from 1.1.2018. The framework agreement's provisions on transferring rights and obligations include provisions for the consequences of such changes.

The competition will be cancelled due to an error in the tender documentation that cannot be legally corrected. The competition should have been decided on the basis of the lowest price award criterium. The award criterium price was formulated so that tenderers should return the completed price form, with the total tender sum forming the basis of the tender ranking. The lifetime of the tenderer's product in the price form has been made a criterium for adjusting the volume that will form the basis for comparing prices. If the lifetime is adjusted beyond the contracting authority's expected lifetime, the volume is reduced. The price form does not, therefore, ensure that the tenders will be treated equally. The tenders in this competition are not comparable as this mechanism in the price form means that tenderers have based their prices on different volumes when submitting a tender. We cannot change the tender price by increasing the volume in accordance with the contracting authority's expectations without breaching the ban on negotiations or the predictability principle in the procurement law. The price form assumes that the contracting authority's needs in the framework agreement's lifetime are reduced and increased for equipment where the expected lifetime is less or more than the length of the framework agreement. As a result of this, the price form has generated an incorrect and different needs estimate in the received tenders. The price form thus generates incorrect actual assumptions regarding the contracting authority's needs, in a way that is not in accordance with the actual realities, where the need does not change within the framework agreement's lifetime because the offered product has an estimated lifetime that is longer than the lifetime of the framework agreement. The above mentioned conditions and the effect of the price form are contrary to the equal treatment principle and the proportionality principle in the Public Procurement Act dated 16.7.1999 No 69 § 5. Furthermore, the price form has an in-built mechanism that means that when a tenderer offers the same expected lifetime as the guarantee period, the annual price for service and maintenance will not be included in the price comparison. This mechanism in the price form has been a premise for the tenderers' pricing of service and mechanism and the tenders cannot be corrected without breaching the predictability principle and the ban on negotiations. As the price form is based on different volumes for calculating the price of the service and maintenance contracts, the tenders cannot be compared on equal terms in this competition. This is a breach of the equal treatment and predictability principle, cf. the Public Procurement Act § 5. This is, under all circumstances, an effect that the contracting authority cannot accept. After assessing the above mentioned conditions, we have concluded that the price form is not suitable for deciding the competition based on the contracting authority's needs. Furthermore, it is designed so that the tenders in this competition cannot be compared on equal terms. These conditions are of such character that they cannot be corrected legally after the tender deadline without breaching the ban on negotiations and the equal treatment principle, cf. the Public Procurement Act § 5. Based on the above, the tenders cannot be compared on equal terms, cf. the Public Procurement Act § 5. The competition is cancelled, cf. the public procurement regulations § 22-1.
