The procurement concerns entering into framework agreement for the purchase of temporary employees for the Health and welfare sector in order to cover the Contracting Authority's extraordinary need for nurses, nursing assistants/carers/healthcare workers and doctors secretaries. There is large uncertainty connected to the need for purchase of temporary employees, dependant on the general work market and the municipality's possibility to use their own personnel, but it is anticipated that the annual use of temporary employee services will be between 500 000 and 1 500 000 NOK. The scope of the service purchase, such as is estimated in Annex 3 to the tender documentation (price form), does not involve any purchasing obligation for the Contracting Authority, if access to their own temporary employees is better than expected. Aure kommune works in parallel to recruit their own temporary employees and permanent employees. The tenderer is obliged to follow the at any given time valid tariff agreement, local wage setting, as well as the stipulations in the Temporary Agency Work Directive valid from 1.1.2013, so that temporary employees are ensured the same wages as an individual would have as an employee of Aure kommune.

It is presupposed that the tenderer follows the regulations on wages and working conditions. The tenderer is thus obliged to have wages and working conditions for their own employees and hired persons that as a minimum fulfil the requirement in accordance with the Working Environment Act and the at any given time valid nationwide tariff agreement for the relevant industry. Wage and work conditions in this instance means provisions on working hours, wages, including overtime supplements, shift and rota supplements and inconvenience supplements and coverage of expenses for journeys, food and lodgings, to the degree that such provisions are in the relevant tariff agreement.
It is presupposed that the tenderer follows the regulations on wages and working conditions. The tenderer is thus obliged to have wages and working conditions for their own employees and hired persons that as a minimum fulfil the requirement in accordance with the Working Environment Act and the at any given time valid nationwide tariff agreement for the relevant industry. Wage and work conditions in this instance means provisions on working hours, wages, including overtime supplements, shift and rota supplements and inconvenience supplements and coverage of expenses for journeys, food and lodgings, to the degree that such provisions are in the relevant tariff agreement.
This also applies for sub-providers, if any.
Failure to comply with this provision gives the Contracting Authority the right to terminate the contract.
