Open tender contest regarding framework agreements with service providers of debenture loan

Trondheim kommune (Trondheim municipality)

Trondheim municipality will therefore carry out an open tender contest where the objective is to enter into parallel framework agreements with service providers of debenture loans. The agreement period is 1.8.2015-31.7.2016. Unilateral option for the contracting authority to prolong the agreement with further 1+1+1 year.
The tender competition involves ordinary municipal loan raising (debenture loan). The procurement will also include any refinancing of existing debenture loans and refinancing of loans in the bonds and certificate market. The agreement will not include loans in the bonds and certificate market as well as forward rate agreements, as these are exemptions in the Public Procurement Regulations § 1-3 (2), letter E.
The contracting authority will enter into a framework agreement with up to 5 service providers. Call-offs against the framework agreement will be implemented as a ‘mini contest’ between framework agreement providers and certificate and bond loans providers. This means that providers of certificate and bond loans will be invited to participate in a mini tender contest, concurrently with providers of bank loans. The municipality may choose to utilise the certificate and bond market if this is found more suitable.

Requirement:

— The tenderer must be a legally established company.

— It is required that the service provider has a licence to operate as a bank, credit rating agency, finance company or life insurance company.

— The tenderer shall have his tax and VAT payments in order.

— The tenderer shall comply with the regulation's requirements in relation to HSE.

Documentation requirement:

— Company Registration Certificate (§ 17-10)

— Documentation verifying licence

— Certificates for tax and VAT, not older than 6 months. The certificates can be obtained from the local tax collection office or the tax office. (§17-14). Use RF-1244.

— Norwegian tenderers who are not VAT obliged must provide confirmation of this from the tax authorities. (§17-14). Use RF-1244.

— Foreign tenderers must provide certificates from equivalent authorities to the Norwegian authorities.

—HSE self-declaration must be filled in (§17-15) see Appendix 3.

— The tenderer shall have a documented rating of at least A or equivalent from at least 1 of the 3 approved rating companies Moody's, Standard & Poor or Fitch. The contracting authority reserves the right to verify that the tenderer has such rating.

— The company's most important deliveries over the last 3 years, including their values, dates and recipients (§17-9).

—The company's environmental status should be confirmed by completing the enclosed form. Environmental requirements for the company ( § 17-13, 2) see Appendix 4.
