Lier kommune

Lier municipality would like to enter into a contract for all legal areas for all our entities in the municipality.
The aim of the procurement is that Lier municipality shall have full legal coverage when the need for external assistance occurs. The municipality currently has a municipal solicitor, two permanent lawyers who work with planning and building cases and one who is dedicated to child protection cases. The contract that shall be signed is for the need in addition to the municipality's own legal resources, or competence, and it must be available at short notice.
Based on experience, Lier municipality will require legal assistance for assignments that cover several different legal areas. It will, thus, be appropriate to have a contract for all services - i.e. a framework agreement that covers all legal services wtihin the relevant legal areas.
If Lier municipalitiy chooses to employ more lawyers in the future, the need for external services can be affected, without this giving the service provider any rights due to fewer assignments.

· Assistance in any disputes - including negotiations and procedures

Tax certificate - Requirement: Tenderers must have submitted their tax assessments and paid tax and employer contributions. Documented by: Tax certificate. The certificate shall not be older than 6 months, calculated from the deadline for receipt of tenders. Any arrears or other irregularities must be justified. If the tenderer is planning to use sub-suppliers, tax certificates must be provided for them as well.

VAT certificate - Requirement: Tenderers must have submitted their VAT assessments and paid VAT. Documented by: VAT certificate. The certificate shall not be older than six months, calculated from the deadline for receipt of tenders. Any arrears or other irregularities must be justified. If the tenderer is planning to use sub-suppliers, tax certificates for VAT must be provided for them as well.

Company Registration Certificate - Requirement: Tenderers shall be a legally established company, this also applies to any sub-suppliers. Documented by: Company Registration Certificate or equivalent from the tenderer's home country.

HSE self-declaration – Requirement: The tenderer shall vouch that the company operates systematically to fulfil the requirements of health, environment and safety legislation and that they satisfy internal regulations. The tenderer must also confirm that the company is legally organised in relation to applicable tax and working environment regulations for employees' professional and social rights, and shall accept that the contracting authority has the right to review and verify the company's system for safeguarding of health, environment and safety. Økonomisk og finansiell stilling:

The applicant shall have a credit rating of at least A/AN. Lier municipality will collect this information from Bisnode (previously AAA Soliditet AS) in weeks 24-25.

Declaration on wage and work terms - Tenderers shall document that the wage and work terms are in accordance with the general tariff agreements. Documented by: The signed form Declaration on wage and work terms.

Experience from equivalent assignments and professional competence within the discipline. The contracting authority requires tenderers to have experience from equivalent assignments. Documentation that the requirements are fulfilled: Enclose the company's most important contracts in the last three years related to comparable customers.
