Vilkår for deltakelse
Egnethet til å utøve yrkesvirksomheten:

— Registration in the company register — copy of a company registration certificate.

— Central certification for the company — copy of the certificate. Alternatively documentation can be enclosed that proves that the company has achieved local certification and has been given the right to be responsible for measures in development class 2 during the last 2 years.

— Apprenticeship scheme — documentation of affiliation with a certified apprenticeship scheme and information on the number of apprentices at the time the tender is submitted.

— Wage and work terms — self-declaration stating that employees at the tenderer, and at any sub contractors who are directly involved in fulfilling the contract, have wage and work terms that are not worse that those in the current nationwide tariff agreement, or what is otherwise seen as normal for the place and profession in question, as stated in the Regulations on wage and work terms in public contracts 2008-02-08 no. 112., also cf. the ILO convention no. 94.

— Use of foreign labour — self-declaration that states that all relevant conditions connected to wages, taxes and duties etc. are in order and that the tenderer is obliged, upon request, to present relevant documentation to the builder for inspection.

— HSE self-declaration — self-declaration on health, environment and safety (HSE) in accordance with the ‘Internal Control Regulations’.

Økonomisk og finansiell stilling:

— Certificate for paid tax and VAT — copy of a certificate issued by the competent authority, confirming that the tenderer has fulfilled his obligations as regards the payment of taxes and duties in accordance with the current legislation. The certificate must not be older than 6 months, calculated from the deadline for receipt of tenders.

— Sufficient financial ability and security to fulfil the contractual obligations shall be documented in the following way:

Copy of a credit assessment/rating carried out by a publicly certified credit rating institution. The assessment shall not be older than 6 months and it shall be based on the last known accounting figures and include accounting information with the key figures for the last 3 years. The credit rating shall conclude that the company is credit worthy. If the accounts show negative figures/deficit in one, or both, of the last 2 years, additional confirmation must be enclosed from a financial institution stating that they will provide security of 5 % in addition to what is stated in the general contract terms.

— Liability insurance — copy of an insurance certificate that documents satisfactory liability insurance in accordance with NS 8405 point 10.2.

Teknisk og faglig kapasitet:

The tenderer's suitability — documented by a short description of, and certificates from a minimum of 2 relevant projects carried out in the last 5 years. Relevant projects in this connection will be major public buildings carried out as a general or main contract.

— The tenderer's capacity — documented by an overview of the company's total manpower, including manpower strength and administrative manpower.

— CVs for key personnel responsible for carrying out the contract:

a) Project manager.

b) Construction site manager.

c) ITB-coordinator.

Andre særlige vilkår:

Measures against social dumping:

1. The work shall be carried out by the tenderer and his employees in a contractual relationship, possibly by sub contractor(s) and their employees. The tenderer shall always be able to present documentation of employment conditions. The tenderer shall be able to document that the majority of those who carry out the work have a certificate of apprenticeship in their discipline.

2. Contracts for sub contract(s) with one-person companies, or the use of hired labour require a written justification from the tenderer.

3. The tenderer is obliged to ensure that the same terms as for the use of his own employees, for one-person companies, hired labour and documentation requirements for certificates of apprenticeship, are included in contracts with sub contractors. Any hired labour shall be in accordance with the Working Environment Act § 14-12a and § 14-13.

4. Norwegian is the main language on the municipality's construction sites, both written and oral. At least one person is required in each work team who understands and who can make themselves understood in Norwegian.

5. No more than 2 chains are allowed in the contract chain. The contracting authority can approve 3 links if a good reason is presented. There shall never be more than 3 links in the contract chain.

6. The tenderer, and any sub contractors shall be certified and active apprentice companies. When the size of the project allows, the contracting authority can require that apprentices are used in the project (applies to Norwegian companies).

7. According to the Taxation Act § 6-10, with the accompanying regulations, businesses that have given assignments on a construction site are obliged to notify the Central Tax Office for Foreign Cases of any foreign companies, or foreign employees, who carry out assignments at the construction site.

8. The tenderer shall continually report the use of foreign labour in all chains in the contract chain, including obtaining and presenting a copy of the sent notification for each foreign company or foreign employee to the contracting authority.

9. Wages and other remuneration for all employees shall be paid to an account in a Norwegian bank.

10. The tenderer shall document valid occupational injury insurance for all employees, and the contracting authority is given the right to check the information.

11. The contracting authority can demand day fines from the tenderer if he himself, or some of his sub contractors use illegal or non-contractual labour and the conditions have not been corrected by a deadline given in a prior written warning. The day fine will run from the when the deadline expires until the documented conditions cease. The day fine shall make up 1 % of the contract sum, but not less than 1 000 NOK per working day.

12. The tenderer shall ensure that employees in their own organisation and the employees of any sub-contractors do not have other wages and working conditions than those required by collective agreements, regulations or that which is normal for the location and occupation, cf. § 5 in the regulations on wage and work terms in public contracts. The tenderer shall, upon request, present documentation on employees' wage and work terms. All contracts that the tenderer signs within this contract shall include equivalent requirements. If a tenderer does not comply with these obligations, and the conditions are not corrected by a stipulated deadline, the contracting authority has the right to demand a day fine equivalent to that in point 11.

13. The tenderer is obliged to obtain documentation from his sub contractors that they and their employees are registered in the employer and employee register (the AA register). The contracting authority can demand that this documentation is presented.

14. If a breach of the above mentioned conditions is ascertained, and the tenderer has not corrected the error by a mentioned deadline, the contracting authority can cancel the contract, and impose a 2 year quarantine.
