The objective of the procurement is to cover the Contracting Authority's requirement for pavilions in connection the need for temporary buildings, with a duration of up to 5 years.
The Follo area is expected to have a high demographic increase in the next years. The Contracting Authority expects that the requirement for temporary buildings will increase while awaiting completion of new buildings, and also expects that new requirements will occur.
The contracting therefore wish, with this procurement, to establish an agreement with 3 tenderers that can comply with the Contracting Authority's requirements during the period in question. The contracting authority expects that it will primarily be requirements in relation to nursery schools, before-and-after school care services with kitchens, and office premises with meeting rooms. However, it must also be possible to deliver other buildings in accordance with requirements. I.e. housing units.

The framework agreement includes a complete delivery of the pavilions. This means engineering design, assembly/installation, and lease including operation and maintenance of the pavilions, as well as disassembly and dismounting the pavilions when the lease agreement is concluded.The contracting authority will be responsible for the groundworks. This means that the municipality delivers a ready levelled wallboard adapted for water, road and fibre.Primarily the framework agreement applies to leasing of pavilions, but it may be relevant to procure the pavilions when the leasing period is concluded. It shall also be possible to just procure the pavilions without any prior leasing agreement.It is difficult to estimate the actual requirement for pavilions. The reason for the requirement for temporary buildings is that the demographic increase and alterations in the population composition occur in peaks, which means it is difficult to predict the increase beforehand.

Vilkår for deltakelse
Egnethet til å utøve yrkesvirksomheten:
Tenderers must have their affairs in order with respect to the payment of tax, employer contribution and value added tax (VAT).
Tax certificates not older than six months from the deadline for receipt of tenders. Tax certificates are defined as:
For Norwegian tenderers:
— Forms from the tax directorate (RF-1316) regarding tax and VAT. The forms are issued by the Norwegian Tax administration.
For foreign tenderers:
— Foreign tenderers must submit equivalent certificates from their own country that show that they have their tax and duty payments in order. If the authorities in the relevant country do not issue such certificates, the tenderer should submit a declaration which states that all taxes and duties have been paid. The declaration shall be approved and signed by the tenderer's Financial Director/ person responsible for Finance.

The tenderer must fulfil Norwegian HSE requirements for work that is carried out in Norway.
— Completed and signed HSE self-declaration in accordance with Public Procurement Regulations, Annex 2. Please use the attached template, see part 1 annex A.
The tenderer shall be a legally established company:
Norwegian tenderers:
— Company Registration Certificate.
Foreign tenderers:
— Confirmation that the tenderer is registered in a trade register or a Register of Business Enterprises, in accordance with the law in the country where the tenderer is established.
The tenderer must have good conduct.
The tenderer will by way of a self-declaration confirm that the requirements in appendix B are fulfilled.

The tenderer shall have sufficient financial strength to comply with the contractual obligations.
Credit appraisal from an approved credit rating institution, e.g. Experian AS, Bisnode Credit AS or Lindorff AS or equivalent. The credit assessment shall not be older than six months. The credit assessment must show a minimum of ‘credit worthy’ or equivalent, to be approved.

The Contracting Authority reserves the right to require/obtain further information in order to verify that the tenderer fulfils the requirement.

1. The tenderer shall have sufficient financial strength to be able to fulfil the contract.
Teknisk og faglig kapasitet:
Tenderers must have adequate implementation ability.
A short, overall description of the company shall be given, including:
— An account of the company's business concept and core competence related to the scope of the delivery.
— An overview of the company's history, organisation and ownership, as well as a description of the current business.
— Description of how the tenderer is organised for the implementation of this contract.
— A brief description of the overall quality assurance system that the tenderer will use for carrying out this contract.
The tenderer may choose to rely on other companies' capacity to meet the technical and professional qualification requirements.
The tenderer must, in such an event, substantiate that the resources of the companies on which he will rely and prove that he will have the requisite resources from these companies at his disposal during the contract period, by,for example by presenting a declaration of commitment (Annex D), guarantee, co-operation agreement or similar.

This applies regardless of the legal nature of the connection between the companies, i.e. that the supporting companies can either be the tenderer's parent company, another company in the same group, a co-operation partner etc.
The tenderer shall have good experience from equivalent assignments:
A list with a minimum of 3 similar contracts in the last 3 years must be presented. The list shall as a minimum contain:
— A brief description of the assignment.
— Date of execution.
— Scope of the assignment in monetary amount.
— Name, and telephone number of the reference person at the contracting authority.
The Contracting Authority must have the possibility to contact the contact persons who are listed.
The tenderer shall have local certification for the right to accept responsibility in accordance with the Planning and building act for the works/the relevant employees.
This shall be substantiated by either presenting local certification, or by documentation which verifies that the tenderer comply with the qualification and system requirements given in the building matter regulations. The measures are placed in enterprise class 2.

Copy of environmental certification or equivalent documentation of another equivalent scheme.
If a tenderer is not certified, a short account shall be provided that describes how the environment is taken care of in the company and during the production/sale of goods and/or services.
