Framework agreement for groundwork

Bergen og Omland Havnevesen

The framework agreement concerns the execution of groundwork and maintenance in the form of machine/groundwork in connection with the municipality's buildings, facilities and infrastructure with technical operation and maintenance.
Groundwork/maintenance work means i.a. work related to the operation and maintenance of the existing buildings, repair of external W&S pipes in the event of a rupture etc.
The framework agreement also includes asphalt and binder course with prices per ton. The Contracting Authority is not obliged to purchase materials through this agreement, and may choose to purchase materials elsewhere than through the tenderer's framework agreement when this is more suitable.
All the assignments shall be carried out in cooperation with Bergen og Omland havnevesenet's port operation administraton department (hereafter the contracting authority).
Most of the properties make up approx. 45 buildings/properties situated in the central port area in Bergen, in addition to the port authority's building in Nøstegaten 30. See Annex 1a for an overview of the Contracting Authority's buildings.
The contracting authority reserves the right to hold separate competitions for major and/or special assignments.

Beskrivelse av opsjoner:
The framework agreement shall be for 2 years, with an option to extend the contract 1 or more times for a further 2 years, to a total of a maximum 4 years.

Qualification requirement no. 1:
The tenderer must have their tax and duty payments in order.
Documentation requirement no. 1:
Certificate for tax and VAT. The certificate shall not be more than 6 months from the tender deadline. The certificate can be obtained electronically in Altinn. For further information, see Skatteetaten.no.
For foreign tenderers:
Foreign tenderers must submit equivalent certificates from their own country, that show that they have an arrangement for the payment of tax and duties. If the authorities in the relevant country do not issue such certificates, the tenderer shall submit a statement which verifies that all taxes and duties have been paid. The declaration shall be approved and signed by the tenderer's Financial Director/ person responsible for Finance.

Qualification requirement no. 2:
The tenderer must be a legally established company.
Documentation requirement no. 2:
Norwegian tenderers:
— Company Registration Certificate.
Foreign tenderers:
— Confirmation that the tenderer is registered in a trade register or company register in accordance with the legislation in the country where the tenderer is established.
Økonomisk og finansiell stilling:
Qualification requirement:
The tenderer should have sufficient financial capacity to be able to fulfil the contract.
Documentation requirement:
The tenderer can document their economic/financial capacity in 1 or more of the following ways:
— Credit rating report from a company that has a licence from the Norwegian Data Protection Authority to operate a credit information company in Norway, possibly from a company with equivalent certification in a member country in the EU/EEA. The credit rating report must be based on updated accounting information.

— Last year's approved Annual Financial Statement including the board's annual report and the auditor's statement. Recently established companies that cannot present approved annual accounts can submit the accounts that have been completed.
— Appropriate bank/parent company guarantees and/or relevant liability insurance. The Contracting Authority will regard bank/parent company guarantees or relevant liability insurance as suitable if these documents cover the Contracting Authority's financial risk where the tenderer does not have the financial or economic capacity to fulfil the contract. The Contracting Authority's financial risk means economic loss caused by non fulfilment of the contract. Parent Companies providing guarantees must document that they themselves comply with the requirement for ‘the company's solidity’.

The tenderer is free to provide other information that can be seen as relevant for the assessment of whether the company's solidity requirement is fulfilled.
The Contracting Authority reserves the right to obtain credit rating reports.
All the received and any obtained information will form the basis for an overall assessment of whether the qualification requirement is fulfilled.
Teknisk og faglig kapasitet:
Qualification requirement no. 1. Requirement of implementation ability — personnel.
The tenderer is required to show good ability to carry out the assignment in accordance with the needs of the Contracting Authority. The tenderer is required, therefore, to have sufficient capacity to be able to complete the task.
Documentation requirement no. 1:
Overview of the company's total manpower, as well as an overview of the number of manlabour years, with competence for special/important disciplines for the fulfilment of this contract.
Qualification requirement no. 2: Professional competence:
Tenderers are required to have sufficient competence to fulfil the assignment in a professionally satisfactory way.
Documentation requirement no. 2. Tenderer shall provide the following documentation:
— A brief presentation of the group of resource persons who shall assist the contracting authority.
— CVs for each person in the group, showing certificates of apprenticeship, education and other relevant practice after completed education.
Qualification requirement no. 3. Experience is required from similar assignments.
The tenderer is required to have good experience from similar assignments.
Documentation requirement no. 3. The tenderer must fill in annex 2 — reference form, on the most important relevant deliveries in the last 3 years, including their scope (number of person months), value, date, contracting authority/recipient, contact information for a contact person for each delivery, as well as a brief description. The Contracting Authority reserves the right to contact the listed references in order to verify the scope and quality.

Qualification requirement no. 4. Requirement for quality management routines.
The assignment requires tenderers who have systems for quality management and effective flows of goods.
Documentation requirement no. 4:
Documentation: (shall be given in 1 of the following ways):
Alternative 1: Description of the company's policy regarding quality management, with emphasis on quality assurance, resource management, management responsibility, manufacturing process and continuous analysis and improvement.
Alternative 2: If a tenderer is certified in accordance with ISO 9001 or equivalent standards, it is sufficient to present a copy of a valid certificate.
