Framework agreement for engineering design services

Stavanger kommune

The contracting authority would like, via this this competition, to enter into a framework agreement for engineering design services (preliminary engineering design, detailed engineering design, general consultancy and preparing technical plans) within water, sewage and roads. Associated assignments in construction, geotechniques, district heating, landscape architecture (LARK), land surveying, as well as coordination between cables and other infrastructure in ditches shall also be carried out.
The framework agreement includes renovation projects and new installations within the above mentioned disciplines. And within the state development classes. The framework agreement cannot be used if work assignments require a higher development class that that stated.
If the value of a relevant engineering design assignment is estimated to be above 500 000 NOK excluding VAT, the contracting authority reserves the right to hold a competition for the assignment; the contracting authority is, in other words, then not obliged to use the framework agreement.
The award of assignments in the contract period (call-offs) will, as a starting point, be done in accordance with the ranking resulting from the evaluation of the award criterium lowest price, cf. chapter 7.
The contracting authority will, however, attempt to divide the total amount of assignments in accordance with the following distribution:
1st place 50 %
2nd place 30 %
3rd place 20 %
If a tenderer abstains from an assignment during a call-off, for example, with a referral to insufficient capacity, the right to a distribution based on a percentage ceases. In such a situation the contracting authority will have the right to use one of the other service providers that the contracting authority has a framework agreement with.

The contract period is two years. The contracting authority shall, in addition, have an option to extend the contract for a further 1+1 years on the same terms. The contracting authority can also extend the contract for a shorter period than one year and the contracting authority shall, thus, have an option for a temporary contract on the same terms. If the contracting authority extends the contract in the first option period for a shorter period than one year, the contracting authority will not take up a new option period.

Egnethet til å utøve yrkesvirksomheten:

The tenderer must be a legally established company.

The contracting authority requires tenderers who wish to participate in the competition to demonstrate that they are registered in a trade index or other enterprise register as prescribed in the legislation in the country in which they are established. Documentation of this (e.g. a Business Registration Certificate from the Brønnøysund Register Centre) shall be enclosed with the tender. The enclosed documentation shall not be older than six months from the deadline for receipt of tenders.

Økonomisk og finansiell stilling:

The service provider must have the financial ability to carry out the contract.

As documentation the contracting authority will obtain the credit evaluation Commercial Delphi Score from Experian (The contracting authority subscribes to services from Experian). The service provider shall achieve a minimum rating of "creditworthy”.

The service provider is expected to have familiarised himself with registered information about the company and by submission of the tender accepts that the information will be obtained and form the basis of the assessment of the service provider's financial situation.

If the tenderer knows that the requirement regarding the financial capacity to carry out the contract cannot be met via the credit rating as specified above, the tenderer can submit other documentation with the tender that confirms a satisfactory financial capacity.

If the contracting authority's credit information about the individual company does not include a credit rating, the contracting authority will seek to have this documentation requirement met in another way, either by assessing whether the financial capacity is satisfactory based on the other information that should be available in the solution from Experian or by obtaining other documentation.

Teknisk og faglig kapasitet:

Qualification requirement 1:

The company is required to have a very good ability to fulfil the contract and considerable experience from equivalent assignments. Equivalent assignments means assignments of an equivalent extent, complexity and value as the assignments for which there can be call-offs for under the framework agreement. Equivalent extent and complexity means assignments that cover all the relevant disciplines; water and sewage, roads, as well as associated assignments in district heating, construction, geotechniques, landscape architecture, land surveying and the coordination between cables and other infrastructure in ditches in accordance with the relevant development classes, cf. requirement 2. Equivalent value means a contract sum between 300 000 NOK and 700 000 NOK for each assignment.

Documentation requirement 1:

Annex 3 shall be flled in to document this. There must be a minimum of three equivalent assignments on the list.

The annex is to include information on:

— A short description of the most important assignments including the development classes.

— Size or value of the assignments

— Time frame (contractual period)

— Name and a brief description of the customers

— Telephone number, e-mail address and name of contact persons for the clients

— Including disciplines and assignments.

Relevant customers from the list may be contacted.

Qualification requirement 2

Tenderers are required to have central certification or substantiate that the tenderer's qualifications are sufficient for local certification to be granted after the contract has been awarded. This applies within the disciplines and development classes mentioned in the following table:

Documentation requirement 2:

Central certification or alternative documentation that substantiates that local certification will be granted.

Qualification requirement 3:

The offered consultants are required to have expertise, cf. the documentation requirement 3 (annex 4).

Tenderers shall offer an assignment manager within each of the disciplines water and sewage and roads. The assignment manager shall be able to function as an engineering design group manager for the project. The contracting authority is free to choose amongst the offered engineering design group managers at call-offs. The engineering design group manager has the general coordination responsibility for the project and is the contracting authority's contact person.

The offered assignment manager within water and sewage and roads respectively are required to have at least eight years relevant work experience (one person for each of the two areas) and at least three years experience with the coordination of projects. Relevant work experience means experience with coordination of the individual disciplines within equivalent assignments and assignment management. Such experience can be obtained as an engineering design manager, project manager or assignment manager, cf. the role and responsibility that the assignment manager shall have, cf. the specifications chapter 6.

Side man inspections within the disciplines roads, water and sewage and construction shall be carried out by offered tradesmen who have at least eight years relevant work experience (one person for each discipline).

Side man inspections within the disciplines district heating, landscape architecture, geotechniques and coordination between cables and other infrastructure in ditches shall be carried out by offered tradesmen who have at least five years relevant work experience (one person for each discipline).

All the offered planners within the relevant disciplines shall have at least two years relevant work experience as engineers or equivalent within the relevant discipline and shall have carried out such assignments during the last 12 months. Two planners for each discipline shall be offered for water and sewage and roads. One planner for each discipline shall be offered for the other disciplines.

Documentation requirement 3:

Annex 4 shall be filled in to document this. The table shall be completely filled in. Furthermore, CVs shall be enclosed for each offered person.

Use of other companies' capacity.

Tenderers can use other companies'qualifications for fulfilment of the requirements for economic and financial position (point 5.5) and/or technical and professional qualifications (point 5.6).

Other companies are defined as other legal entitites (legal subject) than the service provider himself.

This right applies regardless of the legal character of the connection between them. Tenderers can, for example, use a company in the same group, or sub suppliers who shall carry out parts of the assignment.

The contracting authority cannot, in other words, demand that the responsible tenderer and potential contract partner fulfils all the qualification requirements itself. The decisive factor is whether the companies together fulfil the requirements.

The preprequisite is that the tenderer encloses relevant qualification documentation for companies they will use (e.g. a reference list), as well as a binding statement - filled in and signed by a person with the necessary authority, cf. annex 7.

Emphasis is put on the fact that the statement shall also be signed if it applies to a company in the same group, or sub suppliers who shall carry out parts of the assignment. A lack of documentation for such a statement will mean that the contracting authority cannot emphasise the qualifications at the company/companies referred to when assessing whether the qualification requirement is fulfilled.
