EEA 043-2015 Waste Management Services for trade waste, Bergen kommune

Bergen Kommune (Bergen municipality)

Bergen kommune shall enter into a new agreement for waste management services connected to the municipality's trade waste, as well as trade waste to the organisations specified in the Agreement Form.
The agreement shall include collection, transport and responsible final treatment of any waste fractions, cf. the contract's Annex 4A — Price form. When it comes to residual waste, BIR's owner municipalities have awarded exclusive rights for final treatment of waste, and residual waste shall therefore be delivered to BIR Avfallsenergi AS. Food residue from commercial kitchens is an option in the contract, cf. the contract's annex 7.
The contract is for collection services in Bergen municipality.

Requirement: the tenderers shall have their tax and VAT payments in order. Documentation: Tax Certificate, issued by Altinn, the Tax office or the Tax Collection Office. The certificate shall not be issued more than 6 months prior to the tender deadline. Foreign tenderers are to provide certificates from corresponding authorities in the countries where they are registered for tax. If the authorities in the respective countries do not issue such authorisation, the tenderer must present a self-declaration regarding whether there are arrears on taxes and if so, the amount of these. The self declaration must be signed.

Requirements: the tenderer shall be a legally established company. Documentation: Company Registration Certificate, which has been issued no more than 6 months before the tender deadline. Confirmation of registration in a trade or business register as prescribed by the law of the country in which the supplier is established (applies to foreign companies).

Økonomisk og finansiell stilling:
Finance. Requirements: the company's solidity. The tenderer must have sufficient economic and financial capacity to complete the contract. The tenderer is requested to document their economic/financial capacity in one of the following ways:
— Credit rating report from companies that have a licence from Datatilsynet (the Norwegian Data Protection Authority) to operate a credit information company in Norway, possibly from a company with equivalent certification in a member country in the EU/EEA. The credit rating report must be based on updated accounting information.

— The last year's Annual Financial Statement including the board's annual report and the auditor's statement. Recently established companies that cannot present approved annual accounts can submit the accounts that have been completed.
— Appropriate bank/parent company guarantees and/or relevant liability insurance. The Contracting Authority will regard bank/parent company guarantees or relevant liability insurance as suitable if these documents cover the Contracting Authority's financial risk where the tenderer does not have the financial or economic capacity to fulfil the contract. The Contracting Authority's financial risk means economic loss caused by non fulfilment of the contract. Parent Companies providing guarantees must document that they themselves comply with the requirement for ‘the company's solidity’. The tenderer is free to provide other information that can be seen as relevant for the assessment of whether the company's solidity requirement is fulfilled. The Contracting Authority retains the possibility to collect credit rating reports at Proff Forvalt (www.forvalt.no), and use this as the basis for evaluating the company's solidity if the submitted documentation is considered insufficient.

Teknisk og faglig kapasitet:
Requirements: Implementation ability — personnel. The tenderer is required to show good ability to carry out the assignment in accordance with the needs of the Contracting Authority. It is therefore a requirement that the tenderer has sufficient administrative capacity to prepare waste plans in dialogue with the customer within three months after the start up of the contract. Documentation: Overview of the company's total number of man years that are available for the preparation of waste plans and following up of customers.

Requirement: Implementation ability — equipment. The tenderer is required to show good ability to carry out the assignment in accordance with the needs of the Contracting Authority. The tenderer is therefore required to have sufficient capacity to be able to implement the assignment. Documentation: overview of the vehicles that are intended to be used for the implementation of this framework agreement. If it is planned to utilise vehicles that are on order, documentation of the order and delivery date must be submitted.

Requirement: experience from similar assignments. The tenderer is required to have good experience from similar assignments. Documentation: The Tenderer must complete Annex 1 — Reference Form, concerning the three most important relevant deliveries in the last 3 years, including their value, time frame and the contracting authority.

Requirement: procedures for environmental management. The assignment requires tenderers who have procedures and systems that ensure that the execution of the delivery has a low environmental impact. Documentation (should be provided in one of the following manner): Description of the company's routines and systems to ensure a low environmental impact when executing the delivery. If the company has environmental certification or ISO 14001:2004 (or a more recent version) or equivalent third party verified systems, such a certificate will be accepted as documentation for fulfilment of the qualification requirement.

Requirement: Quality management procedures. The assignment requires tenderers to have quality management systems. Documentation (shall be provided in one of the following manners): Description of the company's routines concerning quality management, with emphasis on: —System for quality management, —Managerial responsibility, —Resource management, —Realisation and further development of the service (including customer follow up with respect to optimal sanitation systems), and —Continual analysis and improvement. If the tenderer holds an ISO 9001:2008 certificate (or newer version), such a certificate will be accepted as documentation of compliance with the qualification requirement.

Requirement: the tenderer shall have the necessary authorisations to operate a waste facility and to handle hazardous waste. The tenderer must document that the company has the following authorisations: Authorisation to operate a facility for the treatment of waste according to The Pollution Control Act § 11, cf. § 29. —Authorisation for handling of hazardous waste, cf. the waste regulation § 11-6, cf. § 11-3.
