EEA 042-2015 Professional plan consulting services for case handling of private zoning plan proposals in accordance with The Planning and Building Act § 12-11

Bergen Kommune (Bergen municipality)

The Contracting Authority shall enter into framework agreement for professional plan consulting services for case handling of private zoning plan proposals in accordance with The Planning and Building Act 2008 § 12-11 cf. § 12-10. Primarily this comprises assistance with handling of received plan proposals with regard to preparation of exhaustive review (discipline report) or sub-reports in connection with issuance of the plan proposal for public inspection or forwarding of the plan proposal for political processing to Bergen City Council or issuance for public inspection (first and second hearing of private plan proposal). The consulting services can also include assistance with presentation of planning map with provisions according to the map and planning regulations issued pursuant to The Planning and Building Act 2008, and national product specification for plan for land use.
Work with handling of private planning proposals comprises what is appropriate use of land and balancing of different interests that prevail in relation to the considerations The Planning and Building Act must protect. For example, regard to good living quality, universal design, infrastructure, noise, pollution, risk and vulnerability, protective interests, child and young interests etc. A guide for the work is i.a. overall municipal plans and steering documents. Furthermore there are directives, guides etc. from the state that are available on www.planlegging.no. General deadlines for municipal processing of private planning proposals apply. For planning proposals that shall be issued for public inspection (first processing) a deadline of 12 weeks applies from the time the proposal is received, cf. The Planning and Building Act § 12-11 cf. § 12-10 with regulations.
Call-offs on the framework agreement will be utilised during a lack of competence or capacity at the Contracting Authority, cf. form attached as Annex 8.

Requirement: The tenderers shall have their tax and VAT payments in order. Documentation: Tax Certificate, issued by Altinn, the Tax office or the Tax Collection Office. The certificate shall not be issued more than six months prior to the tender deadline. Foreign tenderers are to provide certificates from corresponding authorities in the countries where they are registered for tax. If the authorities in the respective countries do not issue such authorisation, the tenderer must present a self-declaration regarding whether there are arrears on taxes and if so, the amount of these. The self declaration must be signed.

Requirements: The tenderer shall be a legally established company. Documentation: Company Registration Certificate, which has been issued no more than six months before the tender deadline. Confirmation of registration in a trade or business register as prescribed by the law of the country in which the supplier is established (applies to foreign companies).

Requirements: compliance with HSE regulations. Tenderers who shall perform work in Norway must meet the requirements for health, safety and environment that the Norwegian authorities always stipulate. Documentation: Annex 2 — The HSE Self-declaration is to be filled out. The declaration shall not be issued more than six months before the tender deadline.

Økonomisk og finansiell stilling:

Finance. Requirements: the company's solidity. The tenderer must have sufficient economic and financial capacity to complete the contract. The tenderer can document their economic/financial capacity in the following ways:

— credit rating report from companies that have a licence from Datatilsynet (the Norwegian Data Protection Authority) to operate a credit information company in Norway, possibly from a company with equivalent certification in a member country in the EU/EEA. The credit rating report must be based on updated accounting information,

— the last year's Annual Financial Statement including the board's annual report and the auditor's statement. Newly started companies that cannot present approved annual accounts can present the accounts that have been completed,

— appropriate bank/parent company guarantees and/or relevant liability insurance. The Contracting Authority will regard bank/parent company guarantees or relevant liability insurance as suitable if these documents cover the Contracting Authority's financial risk where the service provider does not have the financial or economic capacity to fulfil the contract. The Contracting Authority's financial risk means economic loss caused by non fulfilment of the contract. Parent Companies providing guarantees must document that they themselves comply with the requirement for ‘the company's solidity’. The tenderer is free to provide other information that can be seen as relevant for the assessment of whether the company's solidity requirement is fulfilled. The Contracting Authority reserves the right to obtain credit rating reports.

Teknisk og faglig kapasitet:

Requirements: Implementation ability — personnel. The tenderer is required to show good ability to carry out the assignment in accordance with the needs of the Contracting Authority. The tenderer is therefore required to have sufficient capacity (at least four employees with professional planning competence) to carry out the assignment. Documentation: Overview of the number of man years with professional planning competence for the execution of this delivery.

Requirement: Experience from similar assignments. The tenderer is required to have good experience from similar assignments. Documentation: The tenderer must complete Attachment 3 — Reference Form, concerning the three most important relevant deliveries in the last three years, including their value, time frame and the contracting authority or recipient.

Requirements for quality management. The assignment requires tenderers who have systems for quality management and effective flows of goods. Documentation (to be provided in the following ways): Description of the company's procedures regarding quality management, with emphasis on quality assurance, resource management, managements' responsibility, the manufacturing process and continual analysis and improvement. If the tenderer holds an ISO 9001:2008 certificate (or newer version), such a certificate will be accepted as documentation of compliance with the qualification requirement.

Requirement: Procedures for environmental management. The assignment requires tenderers who have procedures and systems that ensure that the execution of the delivery has a low environmental impact. Documentation: Description of the company's procedures and systems for ensuring low environmental impact when carrying out the delivery. If the company has environmental certification or ISO 14001:2004 (or a more recent version) or equivalent third party verified systems, such a certificate will be accepted as documentation for fulfilment of the qualification requirement.
