EEA 011-2015 Framework agreement electricity with accompanying services

Bergen Kommune (Bergen municipality)

Bergen municipality currently has a historical electricity consumption of approx. 240 GWh per annum. This is divided between approx. 2 000 sites/site addresses, of which approx. 1 410 are profiled measured sites and 590 are hourly measured sites.
In addition Bergen municipality procures approx. 40 GWh duty free energy. Consideration will be given to winding up the contract for duty free energy, but until a possible contract has been wound up, the service provider must be able to administer this. If the procurement contract for duty free energy is wound up, the volume of the ordinary energy procurement will increase equivalently, i.e. to approx. 280 GWh per annum.

The contracting authority has, amongst other things, a need for the following services connected to the energy procurement: stock exchange trading, invoice administration, customer access through an web-based administration tool, implementation of the contract, any exchange of service provider at the start of the contract (not meter reading), start-up and follow-up meetings and other accompanying services.
The contract also includes an option for the procurement of guarantees of origin for renewable energy.
The contract does not include financial trade/price securing trade on behalf of the contracting authority.

Egnethet til å utøve yrkesvirksomheten:
Requirement: Tenderers shall have their tax and VAT payments in order. Documentation: Tax and VAT certificate, issued by Altinn, the Tax office or the Tax Collection Office. The certificate shall not be issued more than six months before the tender deadline. Foreign tenderers are to provide certificates from the corresponding authorities in the countries where they are registered for tax. If the authorities in the respective countries do not issue such authorisation, the tenderer must present a self-declaration regarding whether there are arrears on taxes and if so, the amount of these. The self declaration must be signed.

Requirements: The tenderer shall be a legally established company. Documentation: Company Registration Certificate, which has been issued no more than 6 months before the tender deadline. Confirmation of registration in a trade or business register as prescribed by the law of the country in which the supplier is established (applies to foreign companies).

Requirements: compliance with HSE regulations. Tenderers who shall perform work in Norway must meet the requirements for health, safety and environment that the Norwegian authorities always stipulate. Documentation: Appendix 4 HSE self-declaration form shall be completed. The declaration shall not be issued more than six months before the tender deadline.

Økonomisk og finansiell stilling:
Requirements: the company's solidity. The tenderer must have sufficient economic and financial capacity to complete the contract. Documentation: Tenderers can document their economic/financial capacity in the following ways: — Credit rating report from a company that has a licence from the Norwegian Data Protection Authority to operate a credit information company in Norway, possibly from a company with an equivalent licence in a member country in the EU/EEA. The credit rating report must be based on updated accounting information. — The last year's Annual Financial Statement including the board's annual report and the auditor's statement. Newly started companies that cannot present approved annual accounts can present the accounts that have been completed. — Appropriate bank/parent company guarantees and/or relevant liability insurance. The Contracting Authority will regard bank/parent company guarantees or relevant liability insurance as suitable if these documents cover the Contracting Authority's financial risk where the service provider does not have the financial or economic capacity to fulfil the contract. The Contracting Authority's financial risk means economic loss caused by non fulfilment of the contract. Parent Companies providing guarantees must document that they themselves comply with the requirement for 'the company's solidity'. The tenderer is free to provide other information that can be seen as relevant for the assessment of whether the company's solidity requirement is fulfilled. The Contracting Authority reserves the right to obtain credit rating reports. All the received and possibly obtained information will form the basis for an overall assessment of whether the qualification requirement is fulfilled.

Teknisk og faglig kapasitet:
Requirement: Experience from similar assignments. The tenderer is required to have good experience from similar assignments. Documentation: Tenderers must fill in annex 5 — reference form, on the 3 most important relevant contracts for the last 3 years, including the contracting authority/customer, extent/GWh per annum and period/contract period.
