Kort beskrivelse:

The contracting authority would like tenders for the delivery of a work boat for operation in Bamble municipality's skerries.

Beskrivelse av opsjoner:

— Crane: Marine crane 6.5 TM, hydr. extension to 12 m.

— Fire pump: Pressure 8-10 bar and 1500 liter/min.

— Heating apparatus/ventilation installations: Fresh air installations with possibilities for heating and air conditioning equivalent to climate installations for mobile homes (roof mounted).

— Windows: Assembly certified blinds for sun screening on all windows.

— Guarantee: Extended guarantee, preferably 24 months calculated from the date of the approved hand over, for contractual delivery including engine and equipment.

The Contracting Authority is free to decide how to exercise the above named options, whole or partially.

Egnethet til å utøve yrkesvirksomheten:

— A VAT certificate is required.

(The VAT certificate is issued by the Tax Department in the region where the contractor has his main office).

— Tax certificates are required for tax and payroll tax The tax certificates are issued by the tax collection office in the municipality where the contractor has his main office.

Joint for both certificates: Certificates, not older than 6 months.

The contractor shall be a legally established company and registered in a trade register, commerce register or company register as mandated in the law in the country where the contractor is established.

— Norwegian companies — Company registration certificate from the Register of Business Enterprises.

— Foreign companies: Confirmation of registration of the company in a trade, register, commerce register or company register as described in the law in the country where the contractor is established.

— A self-declaration is required that states that the contractor fulfils, or will fulfil upon an award of contract, legal requirements in Norway within health, environment and safety (HSE), refer to annex 3 Declaration for HSE.

— The company's most important deliveries over the last 3 years, including their value, time frame and recipient (regarding supplies and service contracts).

— Statement regarding the company's quality assurance system/quality management system.

Økonomisk og finansiell stilling:

— Presentation of the company's annual accounts or extracts thereof (i.e. profit and loss accounts, the balance, the board's annual report and the auditor's report). If the contractor has a valid reason not to submit this documentation, the contractor may demonstrate his economic and financial position with any document that is acceptable to the contracting authority.

Kontraktutførelse
Innskudd og garantier som kreves:

Bank guarantee (cf. point 4 Payment Terms in the Contract):

5 % of the contract sum shall be paid when the contract is signed, this date is to be understood as the date the shipyard is informed that the competent company organs have approved the contract.

The shipyard shall, before payment is made, provide a guarantee for the entire contract amount, with 16% interest per annum in the event of the delivery not taking place.

30 % at the start of construction;

30 % when the plastic hull is completed;

30 % upon hand over;

5% pr. 30 days after hand over.

At the same time the ship is delivered, a supplement also paid or deductions are made in accordance with the contract's provisions.

The shipyard has the right to withhold the ship until the complete settlement is made in accordance with the agreed payment terms.

If the shipyard cannot present a final settlement for the delivery, the orderer can demand that the ship is delivered against a bank guarantee or other satisfactory security for the shipyard's probable remaining receivables.

If there is a dispute about the payment's size before the ship is delivered, including set-off rights for the orderer, he has the right to demand a bank guarantee or other satisfactory security for the disputed amount. The shipyard can in such a case refuse to deliver the ship. If the shipyard does not want to provide security for the disputed part of the bill, the orderer has the right to have the ship delivered against a payment of the amount that is not disputed and to provide a bank guarantee or other satisfactory security for the disputed part of the bill.

When a party has provided security, it expires if the other party has not filed the case in accordance with § 17 at the latest three months after the guarantee was issued. The costs of the security will be divided proportionally between the parties in accordance with the outcome of the dispute.

If the orderer legally cancels this construction contract or it is withdrawn pursuant to § 8, the orderer shall have the right to be refunded the paid instalments with a supplement of 16.% interest per annum from the payment date to when the refund is made.
