The aim of the procurement is to get an operator for bus routes in Gloppen, Jølster, Førde, Naustdal, Flora, Bremanger, Gaular, Fjaler, Askvoll, Hyllestad, Solund, Gulen, Høyanger and Balestrand municipalities (hereafter called Route Package Sunnfjord) from 20.6.2016. A gross contract will be signed.

Vilkår for deltakelse
Egnethet til å utøve yrkesvirksomheten:
(1) Company registration certificate.
(2) Requirement to submit tax certificate for VAT (National requirement).
(3) Requirement to submit a tax certificate for tax (National requirement).
(4) Requirement to submit declaration in accordance with Appendix 2 to the Regulations concerning HSE (National requirement).

Økonomisk og finansiell stilling:
(1) The tenderer's annual accounts including notes with the board's and auditor's report for the last 3 accounting years.
(2) Recent information of relevance for the tenderer's accounting figures shall be enclosed.
(3) Confirmation shall be enclosed from a bank, insurance or financing institution that states that a bank guarantee for correct fulfilment of the contract will be provided. This guarantee is in addition to the licence guarantee for the award of licence.

Teknisk og faglig kapasitet:
See the requirements in the qualification documents point 6.5.
(1) Copy of a coach licence.
If a tenderer does not have a valid coach licence, documentation must be enclosed as required by the regulations 26th March 2003 no. 401 on domestic professional transport by motor vehicle and vessel (the professional transport regulations) § 4 and §§ 6-8, cf. § 10 in order to be issued with such a coach licence. Such documentation is:

— documentation of good conduct from the manager;
— documentation of satisfactory financial ability at the company or the manager if the company is newly established;
— documentation of sufficient professional competence in the management.

(2) The tenderer's references for relevant assignments in the last 3 years. The references shall at a minimum include:
— The contracting authority and a contact person.
— The annual value of the contract.
— The start and completion date.
— A brief account of the assignment.
(3) If a tenderer will use other companies' capacity, documentation in accordance with the Public Procurement Regulations § 17-9(2) shall be enclosed.
(4) An account and documentation of the tenderer's quality assurance/control system, as well as the personnel who are responsible for quality assurance.
(5) Tenderers shall enclose the current driver routines.

Deadline for proceedings to acknowledge an ineffective contract, shorten contract or impose violation penalties is set out in PPRFOA § 22A-3. Note that the deadline for claims about sanctions for illegal direct procurements is reduced from two years to 30 days if the Contracting Authority announces the contest results in accordance with PPR § 18-4, c.f.. § 22A-3 no. 2.

For applications with claims for compensation, the Limitations deadlines apply according to the Limitation Act.
Interim court order may be decided upon, until the contract is entered into, c.f. the Public Procurement Act § 9. If the Contracting Authority has set a fixed waiting period, a request for interim court order can be submitted before the expiry of the waiting period so that it can have automatic suspensive effect, cf. PPR § 22-3a no. 1. The contracting authority may, in certain cases, set a deadline for when the request for interim court order shall be submitted. This applies for the contracting authority's decision to reject or cancel a request for participation in a tender contest with pre-qualification. C.f. PPR § 19-7 and the ministry's instruction, point 11.4.

Deadlines for lodging appeals to KOFA (the Norwegian Complaints Board for Public Procurement) are in accordance with the regulations regarding the appeals board for public procurements. C.f. particularly § 6 and § 13a. Note that the deadline is 2 years for claims about direct procurement. If the application deadline has expired due the the Contracting Authority announcing the contest result in accordance with PPR 18-4, the tenderer can ask KOFA for an advisory statement about whether there is an illegal direct procurement.
