0 General.

It is a general requirement that the tenderer is qualified to carry out the work offered. The provider shall have the necessary competence and experience, both technically, professionally, organisation wise and administratively.

Information on the provider shall be given on the response form in section E2. It is important for assessment that the information and documentation is correct and complete.

If the tenderer is a working partnership, attached to the tender there must be a declaration of joint liability to the General Contractor and third parties,cf. point. 3 below. Furthermore, each individual partaking company in the working partnership must provide information on their company as is required in the tender documents. Working partnerships will be assessed collectively for all eligibility requirements except HSE and own equity. Each participant will be individually evaluated for HSE and equity.

Please not that the General Contractor can collect information from the Brønnøysund registers and from given references. If grossly inaccurate information is given, this can lead to rejection, cf. Directive on Public Procurement (DPP) (foa)

§ 11-10 (2) g and§ 20-12 (2) g.

Your information will be discretely evaluated. The General Contractor will also focus on information from self evaluations of the provider.

Providers who do not meet the General Contractor's requirements for qualification will be rejected, cf. DPP § 8-4 and § 17-4. Every single requirement must be met. Each requirement which is not met will result in the provider being rejected.

The documentation with the offer for tender will be the basis for the General Contractor evaluating whether requirements are met. Missing or inadequate documentation in one or more criteria can result in the offer being rejected.

1 HSE-declaration

There should be an HSE declaration with the offer for tender, cf. DPP § 8-8 (1), ce. § 17-15 (1).

2 Tax Certificates

With the offer for tender there should be tax certificates for VAT and tax, not older than 6 months. Cf. DPP § 8-7, ce. § 17-14.

3 Working partnership: declaration of joint liability

If the tenderer is a working partnership, attached to the tender there must be a declaration of joint liability to the General Contractor and third parties.

4.3 Economic situation.

4.3.1 Equity. Solvency.

It is a requirement that the provider's equity is positive. If the tenderer is a working partnership, the requirement applies for each participant.

Documentation requirements:

Documentation of equity is to be provided with the offer for tender. Cf. Chapter. E2, point. 4.3.1, form E2-4.3.1.

Documentation of any significant changes to the providers equity and solvency compared to the last accounts audit must accompany the offer of tender.

Teknisk og faglig kapasitet:

4 Required Qualifications.

4.1 Experience.

Providers who are newly established companies who cannot submit references, must be particularly careful to demonstrate that they have the ability to carry out the contract. The provider shall report their company formation and employee expertise. Planned organisation for the assignment and CV s for key personnel in the project organisation are extremely important. This also applies for companies that merge or are acquired by another company during the offering process.

4.1.1 Experience from similar works Reference projects

The provider shall have experience from work of the same nature and difficulty.

Required documentation:

Information on such will be sent with the offer. Cf. Chapter. E2, point. 4.1.1, form E2-4.1.1.

4.1.2 General Contractors experiences Reference projects

NPRA and other general contractors experiences with the provider will be evaluated.

The tenderer is required to show references to relevant contracts that they themselves have carried out in a satisfactory manner.

Conditions which will be evaluated are related to amongst other things:

— documentation of completed quality

— fulfilment of contracts

— compliance with provisions and procedures for HSE

— compliance with provisions for wages and working conditions

— observance of deadlines

— follow up during the warranty/claims period

Documentation requirements:

Information about contracts the provider has had in the last few years, with names of references at the awarding authority, shall accompany the offer. Cf. Chapter. E2, point. 4.1.2, form E2-4.1.2.

Any assessment forms from previously completed contracts can also be included in the basis for the evaluation.

4.2 HSE

4.2.1 Accident frequency (H1-value)

The H1-value is defined as the number of work accidents with absence in relation to the hours worked multiplied by106.

The average of the H1-value for the last three years should be lower than 10, Cf. Chapter. E2, point. 4.2.1, form E2-4.2.1.

If the H1-value is higher than this, it should be reported for the developing trend for the H1-value and possibly the F-value, which will express the severity of any high H1-value. Furthermore, a report on whether improvement measures are implemented, and if so also documentation on the effectiveness of these, should accompany the offer.

4.4 Feasibility

There will be an overall assessment for the requirements imposed under this criteria feasibility.

4.4.1 Provider's revenue

The tenderer's annual average turnover should be at least as large as the annual revenues the contract will generate.

Documentation of turnover for the last three years should accompany the offer, Cf. Chapter. E2, point. 4.4.1, form E2-4.4.1.

4.4.2 Key personnel competencies

Technical and professional competency and relevant experience is required of the key personnel who will be used for this assignment.

Competency and experience must be documented. Cf. Chapter. E2, point 4.4.2, form E2-4.4.2.

4.4.3 Organisation

It is a requirement that the organisation of the execution of the contract is sufficiently staffed and that the provider has the capacity and ability to deal with unforeseen circumstances during the contract.

Accompanying the offer should be a report on how the provider will organise the implementation of the contract, including areas of responsibility for designated key personnel.

4.4.4 Progress plan

Accompanying the offer should be an orientating work schedule which shows the main activities both

for the mountain tunnel and concrete tunnel.

4.5 Other qualification requirements

4.5.1 Electrical workers

In addition to the training requirements in C2 27.3 for electrical workers in this contract:

— Education of the individual electrical fitter shall be approved by DSB (The Directorate for Civil Protection and Emergency Planning) before mustering at the installation.

— Safety training, set by the DSB, in accordance with FSE: Regulations on Work and Operation of electrical installations.

4.5.2 The provider's plan for Health, Safety and the Environment.

Accompanying the offer shall be a briefing showing how the provider manages their Health, Safety and Environment works in relation to this tender.

4.5.3 Provider's quality plan.

Accompanying the offer there shall be an orientation showing how the provider will safeguard the quality requirements in accordance with this tender.
