2012/465 - Parallel framework agreements, delivery of work equip., protective equip.t/fabric products

In accordance with the public procurement regulations, the awarding authority invites companies to an open competition above the EEA threshold, with the aim of entering into parallel framework agreements for the delivery of workwear, protective equipment and fabric products. The extent of the contract is for a large part classified as high risk products based on documentation on critisied work conditions and constant breaches of the ILO's core conventions in manufacturing in low wage countries. An important sub aim of this contract is to procure products that are manufactured legally and in accordance with the ILO's core conventions.
In order to ensure that the need is always covered, the awarding authority will enter into parallel framework agreements. The contracts can cover all or parts of the product area, but tenderers must at a minimum be able to deliver at least one category. Tenders can therefore be given for all product categories, or for only one or several of them.
Production categories:
1. Workwear for tradesmen, workshop, park, agriculture and cowsheds. Tenders must include clothing for both indoor and outdoor use, as well as summer and winter
2. Workwear for chemical laboraotry personnel, pilot plants within dairy etc.
3. Workwear for hospital personnel and surgical personnel
4. Workwear for cleaners
5. Work shoes/boots for summer and winter use including protective protective shoes/boots
6. Visiting overcoats and shoe covers for disposable use
7. Personnel protective equipment
8. Bedclothes and towels, cloths and curtains.

If services or works shall be carried out as a part of the contract that the competition is for, the following terms with a requirement for the prevailing wage and work terms shall apply, cf the regulations dated 8.2.2008 no. 112 on wage and work terms in public contracts:

Suppliers shall ensure that employees in their organisation and employees at any sub suppliers do not have worse wage and work terms than those in the tariff agreements, regulations or what is normal for the place and profession. This applies only for employees that are directly involved in the fulfilment of the contract. The supplier's manager is responsible for this rule being followed.

All contracts that the supplier signs that involve work under this contract shall include equivalent terms.
If a supplier cannot adhere to the clause, the awarding authority has the right to withhold parts of the contract sum until documentation stating that the condition is met is presented. The sum that is withhold shall be equivalent to approx. twice the savings for the employer.

Suppliers shall upon request provide documentation of the wage and work terms that are used. The documentation obligation also includes sub suppliers. Annex 5 shall be used for documentation of this and this annex shall be provided at the latest 3 months after the contract has been signed.
