New, tightened requirements in the procurement regulations apply from 01.01.2024. The main rule is that climate and environmental considerations shall be weighted with a minimum of 30 percent in all procurements. Instead of applying the award criteria, the contracting authority can set minimum requirements, if these give a clearly better climate and environmental effect than using the award criteria, cf. the Public Procurement Regulations § 7-9 fourth paragraph.
This procurement, with a few exceptions, includes contractual requirements that obligate the tenderer to only use vehicles that are either zero emission vehicles (i.e. 100% battery electric or hydrogen) or biogas vehicles that as a minimum fulfil Euro class 6/VI in the execution of the contract (last transport stretch/cargo mile). Furthermore, the tenderer undertakes to use zero emission machines (i.e. 100% battery electrical or hydrogen) in connection with the execution of the contract, including preparatory work, installation of new artificial grass system and finishing work (except for machines or equipment for filling in sand and property filling, as it will considerably limit the contract to set environmental requirements thereof.
For vehicles and machines where zero emissions and biogas are not required, certified sustainable bio-fuel shall be used in addition to the turnover requirements. Bio-fuel based on palm oil or by-products from palm oil production is not allowed. Vehicles shall as a minimum fulfil Euro-class 6/VI.
Compared to the use of award criteria where the contracting authority cannot guarantee these effects, there is an inherent risk that an additional cost of an electric machinery and vehicle park cannot offset a price jump, all the time traditional fossile machines and vehicles are reasonable alternatives.
The requirements therefore reduce the procurement ́s total environmental footprint in a way that clearly gives a better climate effect as regards direct emissions of climate gases and reduced environmental impact.
